Atlanta Mesothelioma Attorney

When a Georgia company wants to initiate a demolition project, the company must notify the U.S. Environmental Protection Agency (EPA) according to the rules of The National Emission Standard for Hazardous Air Pollutants (NESHAP). This notification must be completed whether asbestos is known to be on the demolition site or not.

Regulated Asbestos Containing Material (RACM)

RACM is defined as friable--meaning that the material contains at least one percent asbestos. The asbestos present must be able to be pulverized, crumbled, or turned into a powder by pressure from human hands. There are different categories of friable asbestos material.

Notification Requirements

The specific EPA agency that requires notification is the Environmental Protection Division, Lead-Based Paint and Asbestos Program. The official notice must be provided on the Asbestos Abatement or Demolition Project Notification form that is provided by the above-named division.

A Georgia-licensed asbestos abatement contractor needs to fill out the form. The form can only be completed after a thorough inspection of the proposed demolition area is completed by the licensed abatement contractor. There is also a fee that needs to be paid upon filing the form.

No RACM Found

If RACM is not found the project can continue. If asbestos is located, notification must be made at least ten days before the proposed removal.

Asbestos Facts

All asbestos fibers are dangerous when inhaled. While some experts believe that certain asbestos fibers are not as dangerous as others, some states disagree and they consider all asbestos as equally harmful.

When you inhale dust, you might sneeze or cough. You might get a runny nose. That does not happen, however, when you inhale asbestos fibers. Since the particles are so small, asbestos “dust” is not like regular dust. In fact, you cannot see, taste, or smell it.

Sophisticated asbestos measuring techniques are able to detect the dangerous substance in the air. Asbestos lung damage can be influenced by the following factors:

  • How much you inhaled
  • How long the inhalation episode occurred
  • Inhalation route (lungs or ingested into the stomach)

Also, your lifestyle, gender, age, and your overall health may be significant factors if and when asbestos-related illness strikes.

Latency Period

The latency period is the amount of time it takes for asbestos symptoms to appear after exposure. Amazingly, the asbestos exposure latency period can be up to 50 years from first contact. Today, those who had inhaled asbestos fibers in the 1970s might just be feeling the effects.
