Connecticut Mesothelioma Case Sheds Light on the Dangers of Talc

Throneberry Law Group

For purposes of this article, the mesothelioma victim in this case will be referred to as Mr. E.P.

A recent mesothelioma lawsuit in Connecticut has attracted significant attention and highlighted concerns over previously unknown dangers of talcum powder in consumer products, notably Johnson & Johnson’s (J&J’s) talcum powder products. In this case, a 64-year-old man is blaming J&J’s talcum powder products for his mesothelioma. E.P. claims that illness resulted from prolonged use of the giant pharmaceutical company’s talcum powder. The personal injury lawsuit filed in Bridgeport Judicial District Court is part of a growing number of legal actions against J&J. The company has faced numerous lawsuits related to its talc-based products.

Mr. E.P.’s lawsuit centers on his prolonged use of Johnson & Johnson’s talcum powder. Mr. E.P. claims that his mesothelioma diagnosis was a result of using J&J’s talcum powder products to soothe rashes he suffered from as a child due to his weight. In his lawsuit, E.P. said he continued using the product in his youth since he was an athlete. According to the lawsuit, the giant pharmaceutical company failed in its duty to warn consumers about the health risks associated with its talcum powder, which is alleged to contain asbestos.

Asbestos is a naturally occurring mineral that was widely used many years ago in various industries due to its heat-resistance and insulating properties. However, over time, it became known that asbestos, when inhaled or ingested, can cause severe harm. Exposure to asbestos can lead to mesothelioma, lung cancer, asbestosis, and many other illnesses. Unfortunately, because of the long latency period of asbestos-related illnesses, it can take decades for someone to be diagnosed. For example, it can take up to sixty years or more for a person to be diagnosed with mesothelioma after asbestos exposure.

According to Mr. E.P.’s lawsuit, Johnson & Johnson had many opportunities to inform the public about the dangers of their products but decided not to. It is Mr. E.P.’s legal team’s belief that if J&J had acted responsibly, his illness, and the illnesses of thousands of others, could have been avoided. This case has attracted a lot of attention, especially since many other consumers have used J&J’s talc-based products for many years without knowing the dangers.

Johnson & Johnson responded to the allegations by arguing that the claimant’s mesothelioma is unrelated to their talcum powder. The company’s legal team argued that Mr. E.P.’s illness probably arose from his family’s history of cancer. The defendant claimed that their baby powder did not contribute to Mr. E.P.’s illness. Johnson & Johnson also highlighted the plaintiff’s decision to forego surgery and chemotherapy and pursue holistic treatments alongside his reported extended remission. According to the company, that outcome would not have been achievable if Mr. E.P.’s mesothelioma had been caused by asbestos exposure.

J&J continues to work on settling the numerous lawsuits filed against them while pursuing a bankruptcy plan. Courts nationwide have awarded substantial damages to victims affected by the company’s talcum powder products. Hopefully, Mr. E.P., too, will receive the compensation he deserves for his illness.
