Debunking Myths About Mesothelioma VA Benefits

Throneberry Law Group

Mesothelioma is a type of aggressive and fatal cancer. This illness affects the lining of the lungs, abdomen, and heart. Till today, the only known cause of mesothelioma is asbestos exposure. Asbestos is a group of naturally occurring minerals that was widely used due to its durability, insulating properties, and heat resistance. After asbestos exposure, it can take decades for mesothelioma to develop. Veterans are at significant risk of developing mesothelioma because of the widespread use of asbestos in military buildings and equipment until the late 20th century. Veterans who develop mesothelioma may be eligible to recover benefits from the U.S. Department of Veterans Affairs (VA).

Many myths persist about mesothelioma VA benefits. In this article, we debunk some of these myths.

Myth #1: Mesothelioma Is Not Service-Related, So I Cannot Get VA Benefits

Service-related illnesses are health conditions that military personnel may develop because of their service. Common service-related illnesses include post-traumatic stress disorder (PTSD), traumatic brain injury (TBI), hearing loss, Gulf War syndrome, and respiratory disorders. Mesothelioma can also be considered a service-related illness if a veteran was exposed to asbestos during their time in service.

Myth #2: Only Those Who Suffered Asbestos During Combat Can Recover VA Benefits

It is not true that only those veterans who suffered asbestos exposure during combat are eligible to recover mesothelioma VA benefits. Many veterans who were in maintenance, shipyards, or old buildings with asbestos-containing materials suffered asbestos exposure. The VA acknowledges all service-related asbestos exposures and provides benefits to all affected benefits.

Myth #3: I Cannot Recover Mesothelioma VA Benefits if I Wasn’t Honorably Discharged

Indeed, the VA typically awards benefits to veterans who were honorably discharged. However, depending on what the VA decides, a veteran who did not receive an honorable discharge may be awarded mesothelioma benefits.

Myth #4: Filing a Mesothelioma VA Claim Is Too Complicated

Filing a mesothelioma VA claim can be complex. However, resources are available to help veterans with the application process. For example, an attorney specializing in VA claims can help with the application process, gathering evidence, and navigating the claims process. Veterans organizations and Veteran Service Officers (VSOs) may also be of help.

Myth #5: A Veteran Cannot Get VA Benefits if They File a Mesothelioma Lawsuit

Mesothelioma lawsuits and VA benefits claims are unconnected. Filing a mesothelioma lawsuit cannot bar a veteran from recovering VA benefits. In fact, filing a mesothelioma lawsuit on top of applying for VA benefits could be highly beneficial, as it may result in substantial compensation.

Veterans often worry that filing a lawsuit means suing the military or government. This is not true. When a veteran files a mesothelioma lawsuit, they are suing the companies that manufactured, distributed, or sold the asbestos-contaminated products that caused their illness.
