People have been filing mesothelioma and asbestos-related claims for more than three decades now. Over the years, asbestos companies that recklessly exposed people to asbestos have been forced to pay plaintiffs huge amounts of money. Because of the huge payouts, some companies started filing for bankruptcy. Generally, companies began filing for bankruptcy to avoid liability. Most of the companies that chose to file for bankruptcy were not able to avoid liability. This is mainly because, as part of the Chapter 11 bankruptcy, companies were required to establish trusts that would fund victims of asbestos exposure.
The world’s largest chemical company recently agreed to a settlement in a class action lawsuit brought by plaintiffs who allege that the company lied about the presence of asbestos in its talc, which caused various types of cancer including mesothelioma. Per the terms of the settlement, German chemical company BASF will set aside $72.5 million for plaintiffs who filed asbestos cancer lawsuits against the company between March 1984 and March 2011, including those whose claims were dismissed or voluntarily withdrawn.
Mesothelioma is described as localized if the cancer is found only on the membrane surface where it originated. It is classified as advanced if it has spread beyond the original membrane surface to other parts of the body, such as the lymph nodes, lungs, chest wall, or abdominal organs. Diagnosing mesothelioma is often difficult, because the symptoms are similar to those of a number of other conditions. Diagnosis begins with a review of the patient’s medical history, including any history of asbestos exposure.
The dangers of asbestos were known to the owners of the oil refineries and petrochemical and chemical manufacturing facilities long before they were finally forced to stop using asbestos-containing products and remedy the facilities or replace the contaminated machinery. Temperature control is key to the efficient operations of these facilities. As a result, asbestos was used extensively because of its insulation properties. Refineries and chemical and petrochemical manufacturing plants, for example, typically contain miles of piping insulated in the past with asbestos.
Mesothelioma is an aggressive form of cancer whose main cause is asbestos exposure. It can be devastating to get a mesothelioma diagnosis. Often, after people are diagnosed with mesothelioma, they face several daunting questions about their future. Some questions people ask themselves about the future after a mesothelioma diagnosis include whether there is a cure for mesothelioma, how mesothelioma will affect their quality of life, and whether it is possible to live a normal life after a mesothelioma diagnosis. Unfortunately, there is still no cure for mesothelioma.
W.R. Grace and Libby mine located in Libby, Montana contained a deposits of asbestos that continues to receive attention from the Environmental Protection Agency (EPA) today. While the cleanup effort in Libby has been extensive, the dangers of the mine are present throughout the nation. This is because the vermiculite containing asbestos mined from Libby was used extensively in insulation materials shipped to all parts of the country. Asbestos is a naturally-occurring mineral that, when exposed to extremely high temperatures, expands from 8 to 30 times its original size.
