Mesothelioma is a type of cancer that occurs due to asbestos exposure. It is a fatal type of cancer that still has no known cure. Fortunately, if you or a loved one was diagnosed with mesothelioma, you can recover compensation from the negligent party that led to the asbestos exposure.

A group of military attorneys working at Guantanamo Bay prison recently filed a lawsuit to compel the Department of Defense (DoD) to take steps to protect personnel working at Camp Justice. According to the claim, the military forced the plaintiffs to live and work in areas contaminated with asbestos, a cancer causing mineral once commonly used in many construction and industrial applications. Following reports that an unusual number of former personnel deployed to the base developed mesothelioma and other deadly cancers, the U.S. Navy allegedly failed to investigate the situation and take corrective steps.

The University of Arizona’s Cancer Center hopes to become the premier mesothelioma treatment center in the Southwest. A UA thoracic surgeon performed the first successful extraplurual pneumonectomy or radical pleurectomy to treat malignant mesothelioma. Malignant mesothelioma is a rare form of cancer that attacks the lining of the body’s organs including the lungs, heart and abdomen. Mesothelioma is caused by asbestos exposure. Currently there is no known cure for mesothelioma and the life expectancy for mesothelioma is generally six to twelve months from diagnosis.

A Franklin County magistrate recently suggested that a $19.8 million fine be imposed on Paxe Latitude (P.L.), Aloft Management (A.M.), and Paxe Latitude’s majority owner. This is after these parties failed to manage asbestos contamination during renovations, putting workers at risk of mesothelioma and rendering the Latitude Five25 apartment complex uninhabitable. For long, this apartment in Ohio has been a source of controversy. However, nothing has occurred in the past compared to what happened in December 2022.

Virginia Governor Ralph Northam recently signed into law legislation passed by the state legislature which extends the deadlines for which asbestos cancer victims have to file lawsuits against companies they believe are responsible for their diagnosis. House Bill 781 passed unanimously through the House and Senate and will circumvent a decision from the Virginia Supreme Court that ruled the statute of limitations begins on the first diagnosis of any condition related to asbestos exposure. That ruling from the Virginia Supreme Court came in 2013 from the state’s Third Circuit Court of Appeals.

The Pennsylvania State Supreme Court recently heard arguments over how juries may apportion financial liability in asbestos cancer lawsuits as it relates to a state law passed in 2011 meant to provide clear guidance to courts in such matters. Despite the Pennsylvania Fair Share Act’s passage nearly a decade ago, Pennsylvania courts have inconsistently applied the laws as they relate to matters of strict liability, leaving it to the state’s highest court to sort out the appropriate application.
