BACKGROUND
W.R. Grace & Co. faced thousands of asbestos claims, driven in large part by its vermiculite mine near Libby, Montana, and its Zonolite and Mono-Kote product lines. The company reorganized in Chapter 11, and the W.R. Grace Asbestos PI Trust was formed under the First Amended Joint Plan of Reorganization. The trust began accepting W.R. Grace Asbestos PI Trust claims on August 25, 2014.
The trust exists to handle current and future W.R. Grace asbestos claims fairly and consistently. It reviews claims under its Trust Distribution Procedures, or TDP, and pays a set share of each approved claim’s value.
PRODUCTS & COMPANIES COVERED
The trust pays claims tied to W.R. Grace & Co. asbestos products. The best known include the following.
INDUSTRIES, TRADES & OCCUPATIONS
W.R. Grace products were common on construction and renovation sites. Spray-fireproofing crews, insulators, plasterers, drywall workers, carpenters, and laborers handled Mono-Kote and Zonolite directly, and other trades nearby breathed the dust. Home remodeling raised the risk too, because Zonolite sat in millions of attics.
Workers near the Libby, Montana vermiculite operations, and their families, faced heavy exposure. Dust carried home on work clothes exposed spouses and children, so some family members may also qualify.
HOW IT WORKS
Each approved illness has a value under the trust’s TDP. The trust pays a share of that value, called the payment percentage, so money remains for future victims. The current payment percentage for W.R. Grace is 30.1% of the scheduled value under Expedited Review and 30.1% of the gross settlement value under Individual Review. That rate is higher than many other asbestos trusts.
A quick example. At the $180,000 mesothelioma scheduled value and the current 30.1 percent payment percentage, an Expedited Review mesothelioma claim pays about $54,180 from this one trust. Most clients have valid claims against several trusts, so this is one piece of a larger recovery.
THE NUMBERS
Like other asbestos trusts, W.R. Grace groups illnesses into disease levels, with the most serious diseases paying the highest scheduled values. The levels the trust reviews include the following.

FILING OPTIONS
Expedited Review (ER)
The trust checks your records against set criteria and pays the scheduled value for your disease level if you qualify, at the current payment percentage. This track is faster and predictable.
Individual Review (IR)
The trust reviews your case in detail and pays the payment percentage applied to the gross settlement value it assigns. This track can pay more for strong cases, but it takes longer.
GETTING STARTED
A strong trust claim takes preparation. Here is the path most clients walk with our firm.
