TRUST FUND GUIDE
A plain-English guide to the Flintkote Asbestos Trust, how it pays claims, and the current scheduled values for every disease level.
Flintkote made roofing, siding, flooring, and industrial building products, and many of them contained asbestos. If a family member got sick after working with these materials or using them in a home, the Flintkote Asbestos Trust may owe money. This guide explains how the trust works, what claims are worth, and what you need to file. You can also read about the Flintkote Company and the other asbestos companies we handle.
We are Throneberry Law Group, a nationwide mesothelioma and asbestos firm. We help workers, do-it-yourself remodelers, and families file with the Flintkote trust and every other trust they qualify for. Our founding attorney, Michael Throneberry, took on this work after his father-in-law died of mesothelioma, and we give each client direct, personal attention.
CURRENT TRUST STATUS
BACKGROUND
The Flintkote Asbestos Trust pays people who got sick from asbestos products made or sold by The Flintkote Company. For decades Flintkote made roofing, siding, flooring, cement board, and other building materials. Many of these products contained asbestos, and breathing in the fibers can cause serious illnesses years later, including mesothelioma, asbestos-related lung cancer, and asbestosis.
Flintkote faced hundreds of thousands of asbestos claims and filed for Chapter 11 bankruptcy protection in 2004. The Flintkote Asbestos Trust was created under Flintkote’s Amended Joint Plan of Reorganization and began accepting claims on December 14, 2015, paying current and future asbestos claims under a rulebook called the Trust Distribution Procedures (TDP).
The trust handles claims for people exposed to Flintkote products across industrial job sites, construction work, and home renovation. If your exposure ties back to a Flintkote product, you may be able to file.
PRODUCTS & COMPANIES COVERED
The trust covers a wide range of Flintkote building and industrial products. These are the product lines most often tied to Flintkote claims.
The asbestos years for these products run from the early 1950s into the early 1970s. A lawyer can help match your work or home-renovation history to the right Flintkote products.
INDUSTRIES, TRADES & OCCUPATIONS
Flintkote products were common in both industrial work and home building. Roofers, siding installers, flooring workers, carpenters, and do-it-yourself remodelers all came into contact with them. Exposure also happened on industrial and commercial sites where cement board and industrial products were cut and installed. You can read more about exposure across the construction trades.
Because Flintkote made consumer building products, some people were exposed at home rather than on the job. That still counts, and it still can support a claim.
HOW IT WORKS
Flintkote sets a scheduled value for each disease level in its TDP, then pays a share of that value called the payment percentage.
The current payment percentage is 15 percent of the scheduled value on an Expedited Review claim, and 15 percent of the liquidated value on an Individual Review claim. The percentage keeps money in the fund for future claimants.
A quick example. At the $184,000 mesothelioma scheduled value, the current 15 percent payment percentage pays about $27,600 on an Expedited Review claim.
FILING OPTIONS
Flintkote offers a faster fixed-value track and a full-review track.
Expedited Review
The trust checks your records against the standard criteria and pays the fixed scheduled value for your disease level, times the payment percentage. It is faster and predictable.
Individual Review
The trust looks at your case in detail. The value can be higher than the scheduled value, up to a maximum, or lower. It takes longer but offers more upside for strong cases.
THE NUMBERS
These are the scheduled, average, and maximum values in the trust’s Trust Distribution Procedures. The trust pays 15 percent of the settled value.
| Disease Level | Scheduled | Average | Maximum |
|---|---|---|---|
| Mesothelioma (Level VII) | $184,000 | $210,000 | $450,000 |
| Lung Cancer 1 (Level VI) | $20,000 | $25,000 | $40,000 |
| Lung Cancer 2 (Level V) | Not scheduled | $6,000 | $10,000 |
| Other Cancer (Level IV) | $4,500 | $6,000 | $10,000 |
| Severe Asbestosis (Level III) | $15,000 | $20,000 | $35,000 |
| Asbestosis / Pleural Disease (Level II) | $1,400 | $1,400 | $1,400 |
| Asbestosis / Pleural Disease (Level I) | $650 | $650 | $650 |
Lung Cancer 2 has no fixed scheduled value and is handled through Individual Review. Learn more about mesothelioma compensation and how trust claims fit with the rest of your case.
GETTING STARTED
A strong trust claim takes preparation. Here is the path most clients walk with our firm.
1. Gather medical records. You need clear proof of diagnosis, usually a pathology report and a doctor’s statement linking the illness to asbestos.
2. Document your work history. Build a record of every job site, employer, and product you were around. Coworker statements can fill in gaps.
3. Match to covered products. Tie your exposure back to Flintkote products. That link decides whether you qualify and what the claim is worth.
4. Choose your review track. Your attorney helps decide. Well-documented, serious cases often do better under full review; simpler cases often do better on the fast track.
5. File and track. Submit the claim and supporting documents, then follow it through review and payment.
