TRUST PAYMENT REFERENCE
A payment reference for the Owens-Illinois Asbestos Personal Injury Trust, which pays claims for exposure before December 31, 1958 to Kaylo and the other asbestos products Owens-Illinois made or installed. The trust was created in 2022 out of the Paddock Enterprises bankruptcy. Every figure below was checked against the trust's own Trust Distribution Procedures, notices, filing instructions, and approved site list on October 18, 2026.
CURRENT TRUST STATUS
The Owens-Illinois asbestos trust pays 65% of a claim's liquidated value. The trustees raised the rate from 50% to 65% effective August 19, 2026, and claimants who were paid at 50% receive a supplemental payment. A mesothelioma claim carries a $100,000 scheduled value, so an Expedited Review claim pays about $65,000, and the Individual Review track has a $145,300 average value and a $382,600 maximum value for mesothelioma. The trust is one of the newer ones, having opened for claims on October 3, 2022, and it is strict about one thing above all: the exposure must have happened before December 31, 1958, the year Owens-Illinois sold its Kaylo insulation line to Owens-Corning. The trust publishes an approved site list of 2,275 locations and pays claims for workers who were at those sites before 1959.
Throneberry Law Group files Owens-Illinois claims for insulators, pipefitters, boilermakers, refinery and power plant workers, and the families of workers who handled Kaylo block and pipe covering in the 1940s and 1950s, across the country. This page is part of our asbestos trust funds guide, which covers every trust we file against.
PAYMENT REFERENCE
The table below is the short answer. The sections that follow explain each line.
| Current payment percentage | 65% of the liquidated value (Notice re: Payment Percentage Increase dated August 19, 2026). |
|---|---|
| In effect since | August 19, 2026. The trustees, with the consent of the Trust Advisory Committee and the Future Claimants' Representative, raised the rate from 50% to 65% after the review required by TDP Section 4.2. Under Section 4.3, claimants who were paid at 50% receive a supplemental payment to bring them up to 65%. |
| Prior rates | The TDP set an Initial Payment Percentage of 100% for Asbestos Trust Voting Claims (Section 2.3). In a notice dated November 28, 2023, the trustees announced that the trust would pay a first installment of 50% of each approved claim's liquidated value, with any further installment to be set after a payment percentage review. The August 19, 2026 notice treats 50% as the prior payment percentage and raises it to 65%. |
| Review cycle | The trustees must reconsider the payment percentage at least once every three years, starting the first January 1 after the Effective Date, and at least once every twelve months must compare the liability forecast behind the rate with actual claim filings and payments (Section 4.2). Changes require TAC and FCR consent. |
| Inflation adjustment | None posted. The TDP and the trust's website carry no annual cost-of-living adjustment to the scheduled values. The trust does pay a sequencing adjustment of 1% per year, for up to six years, on claims that wait a year or more for payment (Section 7.5). |
| Mesothelioma scheduled value | $100,000 (Disease Level VIII). Individual Review average value $145,300; maximum value $382,600 (Section 5.3(b)(3); trust IR Settlement page). |
| Mesothelioma payout at the current rate | About $65,000 under Expedited Review ($100,000 x 65%). An Individual Review award at the average value would pay about $94,445, and at the maximum about $248,690. |
| Review options | Expedited Review for all levels except Lung Cancer 2 (Level VI) and foreign claims, which must use Individual Review. Individual Review is available for Levels IV through VIII and can produce a value above or below the scheduled value, up to the maximum. Claims that cannot meet the presumptive medical or exposure criteria for Levels I through V, VII, and VIII can also go to Individual Review (Section 5.3(b); Instructions for Filing a Claim revised August 19, 2026). Disputes go to the trust's ADR Procedures, amended October 30, 2025. |
| Extraordinary Claims | A claimant whose exposure occurred predominantly while working in an Owens-Illinois manufacturing facility while it made asbestos products, or was at least 75% the result of Owens-Illinois exposure, with little likelihood of a substantial recovery elsewhere, can be awarded up to five times the scheduled value for Levels II through V, VII, and VIII (five times the average value for Level VI), times the payment percentage (Section 5.4(a)). For mesothelioma that is up to $500,000, about $325,000 at 65%. The claimant must disclose all other claims for the same injury, and an Extraordinary Claims Panel decides disputes. |
| Exposure requirement | Meaningful and credible exposure before December 31, 1958 to asbestos or asbestos-containing products for which Owens-Illinois has legal responsibility, shown by an affidavit of the claimant or a co-worker, or by invoices, employment, construction, or similar records (Section 5.7(b); trust ER Exposure Requirements page). The trust's Approved Site List (updated October 28, 2025) names 2,275 sites where Owens-Illinois products or contracting work are accepted as present, each with the dates the trust recognizes. Mesothelioma needs Owens-Illinois exposure only. Levels II, III, V, and VII also need six months of Owens-Illinois exposure plus five years of occupational asbestos exposure (Significant Occupational Exposure for Levels III and up). |
| Filing deadline | Anyone first diagnosed after January 6, 2020 (the Petition Date) may file within three years after diagnosis or within three years after the Initial Claims Filing Date of April 3, 2023, whichever is later, regardless of any state statute of limitations (Section 5.1(a)(2); Statute of Limitations Notice dated August 2024). The alternative date, April 3, 2026, has passed. Claims first diagnosed before January 6, 2020 and tolled under the TDP had to be filed by December 2, 2024 (November 30, 2024 fell on a Saturday). |
| Fees and withdrawal rules | No filing fee is listed in the trust's filing instructions or on its website; the TDP leaves a fee to the trustees' discretion (Section 6.4). A claim may be withdrawn and refiled without losing its statute of limitations status, but the refiled claim takes a new place in the FIFO queue; processing can be deferred for up to three years without losing queue position (Section 6.3). Since February 5, 2025 the trust enforces a Deemed Withdrawn Policy: a deficient claim, or one on a prepetition or definite statute of limitations hold, is deemed withdrawn if the missing material is not supplied within six months of the deficiency or hold notice. |

| Trust created | Under the Second Amended Plan of Reorganization for Paddock Enterprises, LLC dated April 1, 2022, in the Chapter 11 case Paddock filed on January 6, 2020 (the Petition Date). Paddock was the Owens-Illinois subsidiary formed in 2019 to hold the company's asbestos liabilities. The trust was formed in 2022 and began accepting claims on October 3, 2022. The TDP was amended December 1, 2023 (First Amended TDP). |

SCHEDULE OF DISEASES
The Owens-Illinois TDP uses eight disease levels. Expedited Review pays the scheduled value times the payment percentage. Individual Review, available for Levels IV through VIII, can pay more or less than the scheduled value, up to the maximum value. Lung Cancer 2 has no scheduled value and is paid only through Individual Review.
| Level | Disease | Scheduled Value | IR Average Value | IR Maximum Value | Payout at 65% |
|---|---|---|---|---|---|
| VIII | Mesothelioma | $100,000 | $145,300 | $382,600 | About $65,000 |
| VII | Lung Cancer 1 | $25,000 | $55,900 | $100,700 | About $16,250 |
| VI | Lung Cancer 2 | None (IR only) | $29,400 | $53,000 | About $19,110 at the average value |
| V | Other Cancer | $10,800 | $13,400 | $32,400 | About $7,020 |
| IV | Severe Asbestosis | $28,200 | $39,400 | $82,400 | About $18,330 |
| III | Asbestosis / Pleural Disease | $5,900 | None | None | About $3,835 |
| II | Asbestosis / Pleural Disease | $2,900 | None | None | About $1,885 |
| I | Other Asbestos Disease (Cash Discount Payment) | $400 | None | None | $400 (payment percentage does not apply) |
The payout column is the scheduled value (or, for Lung Cancer 2, the Individual Review average value) times 65%, rounded. Level I is a one-time cash discount payment for an asbestos-related disease that does not meet the Level II criteria; under TDP Section 2.3 the payment percentage does not apply to it, and the trust's posted value is $400.
FILING REQUIREMENTS
The trust checks the disease, the exposure, and the date. The date is the hard part: the exposure must be before December 31, 1958, so nearly every claimant is a worker from the 1940s and 1950s or the family of one.
For every disease level the claimant must show meaningful and credible exposure before December 31, 1958 to asbestos or asbestos-containing products for which Owens-Illinois has legal responsibility (TDP Section 5.7(b); trust ER Exposure Requirements page). An affidavit or sworn statement of the claimant or a co-worker is enough, and so are invoices, employment, construction, or similar records. For Individual Review the trust also accepts work at an approved Owens-Illinois site before December 31, 1958 in proximity to Owens-Illinois products or to work performed by an Owens-Illinois contracting unit. The trust's Approved Site List, updated October 28, 2025, has 2,275 entries across the United States and Canada, each with a site code and the date range the trust recognizes; the trust says more sites will be added. Mesothelioma needs Owens-Illinois exposure only. Lung Cancer 1 and Other Cancer need six months of Owens-Illinois exposure plus five years of Significant Occupational Exposure, meaning at least five cumulative years in an industry and occupation that handled raw asbestos, fabricated asbestos products, worked with asbestos products, or worked regularly alongside those who did. Level II needs six months of Owens-Illinois exposure plus five years of cumulative occupational asbestos exposure, and Level III needs the same six months plus five years of Significant Occupational Exposure. Take-home (secondary) exposure claims are allowed if the occupationally exposed person would have met these rules and the family member's exposure fell in the same period (Section 5.5).
A mesothelioma claim needs a diagnosis of mesothelioma. Lung Cancer 1 and Other Cancer need the cancer diagnosis plus evidence of an underlying bilateral asbestos-related non-malignant disease (a B-read of 1/0 or higher, or an x-ray, CT, or pathology report by a qualified physician showing bilateral interstitial fibrosis, pleural plaques, pleural thickening, or pleural calcification). Lung Cancer 2 is a lung cancer that does not meet the Lung Cancer 1 criteria and is paid only through Individual Review. Severe Asbestosis has stricter imaging and pulmonary function criteria, set out in TDP Section 5.7(a) and on the trust's ER Medical Requirements page. Levels II and III need a physical exam diagnosis (or pathology for a deceased claimant), bilateral disease on imaging or pathology, and ten years of latency; Level III also needs pulmonary function results showing TLC under 80% or FVC under 80% with an FEV1/FVC ratio of 65% or more. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.
Anyone first diagnosed after January 6, 2020 may file within three years after diagnosis, regardless of the state statute of limitations (Section 5.1(a)(2)). The alternative deadline of April 3, 2026 (three years after the Initial Claims Filing Date) has passed, so for a diagnosis today the deadline is three years from the diagnosis date. Claims first diagnosed before January 6, 2020 had to be filed by December 2, 2024 if they were pending against Owens-Illinois or Paddock, tolled by agreement, or still within the statute of limitations on the Petition Date (Statute of Limitations Notice dated August 2024). Since February 5, 2025, a claim that stays deficient or on hold for six months after the trust's notice is deemed withdrawn; it can be refiled, but it loses its place in line.
Expedited Review pays the scheduled value times 65%, about $65,000 for mesothelioma, for a claim that meets the presumptive medical and exposure criteria. Individual Review, for Levels IV through VIII, lets the trust value the claim on its facts up to the maximum value ($382,600 for mesothelioma), and the result can be lower than the scheduled value; the trust's instructions warn that Individual Review usually takes longer. A claimant exposed predominantly in an Owens-Illinois plant, or whose exposure was at least 75% Owens-Illinois, can seek Extraordinary Claim status for up to five times the scheduled value, about $325,000 for mesothelioma at 65% (Section 5.4(a)). Offers come as a release; after the trust reviews the signed release, payment usually follows in one to two months. A claimant who disputes the trust's decision can use the trust's ADR Procedures (amended October 30, 2025) and, after that, the tort system.
RATE HISTORY
The TDP set an Initial Payment Percentage of 100% for Asbestos Trust Voting Claims, meaning claims pending against Owens-Illinois or Paddock, or filed against another defendant, before the plan was filed (Section 2.3). The trust began accepting claims on October 3, 2022, and in March 2023 it announced that claims were being reviewed in FIFO order but no offers were being made yet.
On November 28, 2023 the trustees, with TAC and FCR consent, announced that the trust would issue a first installment payment of 50% of each approved claim's liquidated value, with any further installment to be set after a review of the payment percentage. That 50% figure governed payments from late 2023 forward. On August 19, 2026 the trustees announced an increase in the payment percentage from 50% to 65%, effective that day, after the Section 4.2 review and with TAC and FCR consent. Claimants who were paid at 50% receive a supplemental payment under Section 4.3. The trust posts no annual report on its website, so this page carries no claims-paid totals.
PRODUCTS AND WORK SITES
Owens-Illinois, the glass company, made Kaylo asbestos-containing thermal insulation (block and pipe covering) until it sold the Kaylo line to Owens-Corning before January 1, 1959 (trust history page). That sale is why the trust's exposure window closes at December 31, 1958, and why later Kaylo exposure belongs to the Owens Corning / Fibreboard trust instead. The Owens-Illinois trust also answers for installation and contracting work done by Owens-Illinois units at customer sites before 1959.
The trust's Approved Site List (updated October 28, 2025) names 2,275 sites in the United States and Canada where it accepts that Owens-Illinois products or services were present, with a recognized date range for each. The heaviest concentrations are in Pennsylvania (255 sites), Ohio (205), New Jersey (195), Texas (120), Michigan and New York (107 each), Illinois (96), and Indiana (91). Illinois entries include the Corn Products Refining powerhouses in Argo, the Shell and Standard Oil refineries at Wood River and Roxana, Granite City Steel, Laclede Steel in Alton, Monsanto in Sauget, Argonne National Laboratory, the Great Lakes Naval Supply Depot, Caterpillar in Joliet, and the Owens-Illinois glass plant in Streator. Missouri has 63 entries, including Union Electric's Meramec and Venice plants, Mallinckrodt Chemical Works, the Kansas City Power & Light Hawthorne station, Monsanto and Johns Manville in St. Louis, and St. Louis Shipbuilding & Steel. Kansas has 33.
The same pre-1959 insulation history usually supports claims against Johns Manville and the Owens Corning / Fibreboard trust, and often several more. Our pages on power plant asbestos exposure and products that contained asbestos explain how pipe covering and block insulation released fiber.
QUESTIONS
As of October 18, 2026, the Owens-Illinois Asbestos Personal Injury Trust pays 65% of a claim's liquidated value. The trustees raised the rate from 50% to 65% effective August 19, 2026, and claimants paid at 50% receive a supplemental payment.
The mesothelioma scheduled value is $100,000, so an Expedited Review claim pays about $65,000 at 65%. Individual Review can value a mesothelioma claim up to $382,600 (about $248,690 at 65%), with an average value of $145,300. An Extraordinary Claim can be worth up to five times the scheduled value.
Usually not for a recent diagnosis. Anyone first diagnosed after January 6, 2020 may file within three years after diagnosis regardless of the state statute of limitations. The harder limit is the exposure date: the trust pays only for exposure before December 31, 1958. Claims diagnosed before January 6, 2020 had to be filed by December 2, 2024.
WHY THRONEBERRY LAW GROUP
Owens-Illinois is a strong payer with a narrow door. At 65% of a $100,000 scheduled value, with Individual Review up to $382,600, it is one of the better mesothelioma trusts to have in a case, but only for exposure before 1959, which means the proof usually depends on a decades-old work history, a site list match, and co-workers who may be gone. We build the pre-1959 history from union records, Social Security earnings, employer records, and the trust's 2,275-site approved list, decide between Expedited and Individual Review on the facts, and watch the six-month deemed-withdrawn clock on every deficiency. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
