For purposes of this article, the plaintiff in this case will be referred to as A.H.V. Johnson & Johnson, the famous American corporation, has been sued by tens of thousands of people for its talc-based products. According to claimants, the company’s baby powder and other talc products sometimes contained asbestos. Asbestos is a dangerous substance that can cause mesothelioma and other fatal illnesses. Most litigation has been halted during bankruptcy proceedings, but J&J faced a setback after a recent ruling.

New York City’s asbestos courts recently issued new orders expanding the rights of mesothelioma cancer victims to seek enhanced damages from defendants for the harm caused by dangerously designed and manufactured products. The order is a reversal of a previous New York City Asbestos Litigation (NYCAL) declaration that deferred claims for punitive damages indefinitely and deprived mesothelioma victims the opportunity to hold wrongdoers accountable for their indifference to public safety.

According to the CDC, one factor that makes a person more likely to get severely ill with COVID-19 is the presence of an underlying medical condition. Because of weakened immune systems, cancer patients are among those at high risk of serious complications from a coronavirus infection. Mesothelioma, to be specific, is an extremely aggressive form of cancer associated with asbestos exposure and with limited survival despite systemic therapy. Fighting mesothelioma depletes a patient’s energy and nutrients, and this worsens a patient’s body’s ability to fight COVID-19.

Mesothelioma is a rare form of cancer caused by inhaled asbestos fibers. It is estimated that around 3,000 new mesothelioma cases are diagnosed every year. Usually, mesothelioma develops from the thin layer of tissue that covers many of the internal organs. Unfortunately, mesothelioma is an aggressive and fatal cancer. Because of mesothelioma’s aggressive and deadly nature, early detection and treatment are quite important. However, before beginning treatment after a mesothelioma diagnosis, getting a second opinion is important.

A mesothelioma victim or their family can file a personal injury claim and recover compensation from the party that is to blame for the asbestos exposure.  It is not a legal requirement to retain an attorney during a mesothelioma case, but it is advisable to do so. Mesothelioma cases can be difficult to prove and usually involve large companies with unlimited resources. It is best not to risk trying to prove a mesothelioma case or going against these large companies without the help of an attorney. However, hiring just any attorney is not enough.
