A judge in a Pennsylvania state court recently issued a ruling siding with the plaintiff in a mesothelioma cancer lawsuit, denying the defendant’s motion to transfer the case to another court over a legal technicality. By keeping the case in the Pennsylvania Court of Common Pleas for Allegheny County, the case will continue to move forward despite the best efforts of the defendant’s attorneys to deny, delay, and defend the claim that would help compensate victims and hold the liable parties responsible for causing the victim’s cancer diagnosis.

North Carolina state lawmakers recently voted to advance and asbestos claims bill that could potentially place burdensome restrictions on mesothelioma victims attempting to recover vital compensation needed to cover the costs of medical treatment. The House II Judiciary Committee voted 6-4 to advance Senate Bill 470 for a vote in the Senate, setting up a showdown between parties over the extent to which mesothelioma victims may be required to disclose certain information to the courts.

Dozens and potentially hundreds of plaintiffs in asbestos cancer lawsuits in New York state have been left in a bind after Governor Andrew Cuomo enacted serious budget cuts to the states’ court systems as a cost saving measure due to the Covid-19 pandemic. The $300 million in cuts to the New York state court system went into effect back in September 2020, after the governor used his executive authority to compensate for the shortfall in his state’s revenue due to the coronavirus pandemic. Under New York state law, all judges over 70 years old must be recertified every two years by the state court administration.

A recent report by Reuters claims that pharmaceutical and cosmetics giant Johnson & Johnson knew for decades about the risk of asbestos contaminating its talc-based products, but did nothing to warn consumers about the dangers of exposure to the deadly carcinogen. Those claims come after the news outlet examined thousands of pages of internal company documents going back to the 1970s through the early 2000s that show Johnson & Johnson withheld information about asbestos from the Food and Drug Administration (FDA).
