Mesothelioma is a rare, aggressive form of cancer. Every year, there are about 3,000 new mesothelioma cases in the United States. This disease, which develops in the mesothelium (a membrane that covers the lungs, abdomen, heart, and testes), is primarily caused by asbestos exposure. There is still no cure for mesothelioma, but there are several treatment options. However, it can be notoriously challenging to treat mesothelioma, mainly because this illness is often diagnosed at a later stage when symptoms have become more severe.
Malignant mesothelioma is a disease in which malignant (cancer) cells form in the lining of the chest or abdomen. The malignant (cancer) cells are found in the pleura (the thin layer of tissue that lines the chest cavity and covers the lungs) or the peritoneum (the thin layer of tissue that lines the abdomen and covers most of the organs in the abdomen). For purposes of this article, the claimants in this case will be referred to as S.S. and B.S. In a recent court decision, a Rhode Island judge ruled in favor of two plaintiffs, S.S. and B.S., a couple pursuing justice against Johnson & Johnson (J&J) in a mesothelioma lawsuit. S.S., a mesothelioma patient, and B.S., her husband, filed the lawsuit against more than 40 defendants, including two subsidiaries of Johnson & Johnson, who they blame for negligently exposing her to asbestos through their talc products. J&J and the two subsidiaries petitioned the court to substitute two other subsidiaries in their place.
Many people assume that asbestos has been banned from commercial, industrial, and military use, but the truth is that the substance, often used as an insulation, is merely so heavily regulated that it is “effectively” banned. Federal regulations put in place since the 1970s have essentially outlawed use of asbestos by making it extremely difficult to obtain approval from the federal government for approval of new uses of the substance. However, that does not mean innocent people are still not suffering harm from asbestos exposure.
The long-time talc supplier for one of the country’s largest pharmaceutical and cosmetics giants recently agreed to settlement terms in its bankruptcy proceedings, which would effectively forfeit all of the supplier’s North American assets. The terms of the agreement call for France-based Imerys SA to auction off all of Imerys Talc America, Imerys Talc Vermont, and Imerys Talc Canada and have the assets placed into a trust that would compensate victims who claimed the company caused their debilitating asbestos cancer conditions.
Asbestos can cause many health problems, including mesothelioma and asbestosis. There are different types of asbestos, and all can cause health problems. People who have suffered asbestos exposure and developed severe health problems have the right to take legal action against those who are to blame for their exposure. Often, asbestos exposure victims blame their exposure on producers, bosses, and others who had the duty to protect them. The family of such a victim filed a mesothelioma claim against a general contractor who failed to uphold his responsibility to provide workers with a safe working environment.
