For purposes of this article, the mesothelioma victim in this case will be referred to as L.G. In a recent court decision, the Supreme Court of New York rejected a talc supplier’s motion for summary judgment. This case centers around a woman who we will refer to as L.G. in this article. L.G. was diagnosed with malignant mesothelioma after years of using talc powder products. Kolmar Laboratories, the manufacturer of the products, was named as one of the defendants in L.G.’s negligence claim. Kolmar Laboratories petitioned for removal from the lawsuit, but the company’s arguments failed.
After a person is exposed to asbestos, they may develop various illnesses, including mesothelioma. In the United States of America, it is believed there are approximately 3,000 new cases of mesothelioma every year. While mesothelioma can affect people of all ages, this illness is more common among older people than younger people. According to the American Cancer Society, the average age of people diagnosed with the most common type of mesothelioma, pleural mesothelioma, is 72. Unfortunately, the prognosis of mesothelioma is often poor, and there is still no cure for this disease.
Mesothelioma trial results in a $90 million jury award to a former pipefitter. A jury in Bloomington, Illinois awarded $90million to 59 year-old Charles Gillenwater who is suffering from mesothelioma. Mesothelioma is a rare cancer that attacks the protective lining of the heart, lungs and abdomen that is caused by asbestos exposure. The pipe fitter was exposed to asbestos during the 1970s while working at a several job sites including Bridgestone-Firestone, The Eureka Company and Illinois State University. Mesothelioma cancer invades the mesothelium – the lining of tissue that surround vital organs.
The N.J Supreme Court denied ExxonMobil’s appeal of $7 million mesothelioma jury award. In 2008, Bonnie Anderson argued and the jury agreed that she contracted peritoneal mesothelioma by coming in regular contact with her husband’s asbestos-laden clothes. Malignant peritoneal mesothelioma is an asbestos-related cancer that invades the lining of the stomach and abdomen. Second most after pleural mesothelioma, peritoneal mesothelioma accounts for less than 20% of all mesothelioma cases. As with other mesothelioma types, peritoneal mesothelioma has a long latency period of 20 to 30 years after the asbestos exposure.
Attorneys representing plaintiffs in thousands of talcum powder asbestos cancer lawsuits recently asked a federal judge to allow additional supplementation in evidentiary proceedings following the Food and Drug Administration’s (FDA) testing of talcum powder products. The judge’s ruling in these key evidentiary proceedings are expected to have a tremendous impact on how the thousands of cases in federal court against pharmaceutical and cosmetics giant Johnson & Johnson will play out over the coming months and years.
The family of a former Penn State University professor recently filed an asbestos cancer lawsuit against the school alleging that the victim passed away from mesothelioma cancer that he developed after years of working in dangerous conditions at the educational institution. The lawsuit seeks to recover compensation for the victim’s pain and suffering and hold the university responsible for knowingly placing the victim at undue risk in unsafe work environments.
