How Long Does It Take To Get an Asbestos Trust Fund Payout

Most asbestos trust fund claims pay within several months of filing when the claim is complete and goes through the trust’s expedited review, and some trusts move faster than that for claimants with a terminal diagnosis. The exact timeline depends on which trust you file with, which review path you choose, and whether your medical and exposure records are in order on day one.

At Throneberry Law Group, we file asbestos trust fund claims and lawsuits for mesothelioma clients across the country, and we handle the trust work in-house rather than farming it out. Michael Throneberry has done this for about two decades, and because he lost his father-in-law to mesothelioma, he knows that a family waiting on a payment is often also paying for treatment. We tell clients what the timeline is likely to look like before they file, not after.

Why Do Asbestos Trusts Exist

Asbestos trusts were created because many manufacturers went bankrupt under the weight of injury claims. Under Section 524(g) of the Bankruptcy Code, a company reorganizing in Chapter 11 can set up a trust to pay current and future asbestos claimants, and the company is then protected from being sued.

Because the money is already set aside, a trust claim never goes to trial. That is the main reason trust payments arrive faster than lawsuit recoveries. Dozens of these trusts exist today, including large ones such as the Johns-Manville trust and the Kaiser Aluminum trust.

How Does the Type of Review Affect the Timeline

Most trusts offer two review paths. Expedited review compares your claim to the trust’s published criteria for your disease level and, if you qualify, pays a fixed scheduled amount. In our experience this is the faster route, and for mesothelioma claimants with clean documentation it often concludes within a few months.

Individual review looks at the specific facts of your exposure, your damages, and the law that would apply in your home jurisdiction. It can produce a higher or lower offer than the scheduled value, and it takes longer, sometimes considerably longer. We compare the likely value against the likely delay for each trust before recommending a path.

Can a Hardship Review Speed Up Payment

Some trusts offer a hardship or exigent-health review for claimants with a terminal prognosis or severe financial need. When it applies, this review can move a claim ahead of the normal queue, which can be crucial when time is short. Strong, current medical records are usually required, and the request has to be made correctly the first time.

We raise hardship review with every mesothelioma client at intake. If it is available for the trusts involved, we build the medical file to support it from the start.

What Steps Come Before You Get Paid

Every trust has its own Trust Distribution Procedures, but the path to payment follows a similar shape. These are the steps we handle for each trust claim.

  • Eligibility: We confirm that your diagnosis and your exposure history meet the trust’s criteria, including its list of approved worksites and products.
  • Evidence: We assemble pathology or diagnostic reports, a physician’s statement, and proof of exposure such as work records or coworker affidavits.
  • Filing: We submit the claim with the chosen review path and request hardship treatment where it applies.
  • Review: The trust reviews the claim and either approves it, asks for more documentation, or makes an offer.
  • Acceptance and payment: Once you accept, the trust issues payment at its current payment percentage.

Payment percentages are the piece most people have never heard of. A trust may pay only a portion of its scheduled value so that money remains for future claimants, and that percentage can change over time.

What Can Slow Down a Trust Fund Payout

Missing or inconsistent records are the most common cause of delay. A pathology report that does not match the trust’s disease definition, or a work history that does not place you at an approved site, sends the claim back for more documentation. Filing with several trusts also stretches the overall timeline because each trust reviews at its own pace.

Disputing an offer adds time as well. If you reject an individual review offer, the claim may go to arbitration under the trust’s procedures. We weigh that delay against the potential gain with each client before choosing to fight.

When Should You File a Trust Claim

Sooner is better. Many trusts impose their own filing deadlines, often measured in a few years from diagnosis, and those run separately from the statute of limitations that governs a lawsuit. Payment percentages can also drop while you wait.

Trust claims rarely stand alone. Most of our clients also have a mesothelioma lawsuit against companies that are still in business, and we coordinate the two so neither undercuts the other.

Nationwide Mesothelioma Lawyers at Throneberry Law Group

How long a trust payout takes depends mostly on how well the claim is prepared before it is filed. At Throneberry Law Group, we identify every trust tied to your exposure, choose the review path for each one, and press for hardship treatment when it is available, all while pursuing the solvent defendants in court. We serve clients nationwide, including Spanish-speaking families.

If you have been diagnosed with mesothelioma or another asbestos disease, we can review your exposure history and explain what compensation may be available and roughly how long each source takes. The consultation is free and there is no fee unless we recover for you. Reach us through our contact form to begin.
