In a recent case, a federal court decided that most of a wrongful death lawsuit against Johnson & Johnson and Pecos River Talc will move ahead, even though both companies tried to get significant parts of the case thrown out. The lawsuit was filed by C.C.’s widower, who alleges that his wife developed mesothelioma after decades of using Johnson & Johnson baby powder contaminated with asbestos.

According to the lawsuit, C.C. used J&J’s baby powder in her shoes for years. During colder months, she used it several times a week, and in warmer weather, almost every day. Her husband believes that this consistent exposure to asbestos-contaminated talc products led to her illness.
Mesothelioma is a rare, aggressive cancer that is primarily linked to asbestos exposure. The tricky part is that it often takes decades to develop. The judge rejected most of the company’s arguments. While the claim of negligent misrepresentation was dismissed, the rest of the suit was allowed to move forward. The judge determined there were still unresolved questions that should be left to a jury rather than dismissed early in the litigation process.
Crucially, the court considered claims that Johnson & Johnson might have covered up information about asbestos in their talc products. If proven, this could impact deadlines for filing the lawsuit and allow the family’s claims to continue, even though years have passed.
The judge also stated that the company’s mass marketing and advertising of its baby powder could count as creating warranties or misrepresenting their products, which might support the family’s case.
Finally, the court addressed the possibility of punitive damages. If the jury finds Johnson & Johnson responsible, and if it decides the company showed reckless disregard for consumers’ safety, the family could be awarded not just compensatory damages, but punitive damages too. Depending on the facts, families may recover compensation for a mesothelioma death that includes both compensatory and punitive damages.
