U.S. Bankruptcy Judge Michael Kaplan denied Johnson & Johnson’s second bankruptcy attempt in a recent court decision. This decision offers hope to many mesothelioma and ovarian cancer victims seeking justice from Johnson & Johnson. The consumer giant is facing tens of thousands of negligence claims accusing its talc powder product of causing mesothelioma and ovarian cancer. Sometime back, Johnson & Johnson formed its subsidiary, LTL Management, for the purpose of carrying its talc liabilities into Chapter 11 bankruptcy.

After D.C. Sr. was diagnosed with mesothelioma, he filed a lawsuit in Louisiana state court seeking compensation for his damages from multiple companies.

For purposes of this article, the victims in this case will be referred to as T.W. and J.W. Vermiculite, a naturally occurring mineral with heat-resistant properties, and asbestos, also a naturally occurring mineral, form under the same conditions. Asbestos is a dangerous substance that can cause several fatal illnesses, including mesothelioma. In Libby, Montana, asbestos contaminated the city’s vermiculite deposit, so years of mining this mineral in the city exposed workers and residents to asbestos.

Berkshire Hathaway, owned by billionaire investor Warren Buffett, recently filed suit against Goodyear Tire & Rubber Co. over claims the auto parts supplier failed to disclose asbestos cancer verdicts and settlements from seven years ago. Berkshire’s lawsuit seeks to absolve itself of reimbursing Goodyear for mesothelioma cancer claims that they claim the defendant never consulted with carrier about.

Mesothelioma specialists are working tirelessly to create new mesothelioma treatments. Specialists are working hard to develop new ways to prevent and detect mesothelioma. Currently, there are several treatment options available for mesothelioma that have already been tested in clinical trials and approved. A good number of prevention and detection methods for mesothelioma have also been tested in clinical trials and approved. Usually, the U.S. Food and Drug Administration requires that a treatment option, prevention method, or detection method undergo three or four trial phases before it grants approval.
