In a recent ruling, an appellate court rejected Fort Motor Company’s (FMC) attempt to overturn a jury verdict awarding $3.3 million to Mr. J.S., a mesothelioma victim, and his wife, Mrs. D.S. The decision left intact the jury’s decision that the auto manufacturer was negligent in failing to warn about the risks of asbestos in its brake products, which the jury determined were a significant contributing factor to Mr. J.S.’s peritoneal mesothelioma. Mr. J.S.

A New Jersey state jury recently handed down a $2.38 million plaintiff’s verdict in an asbestos cancer lawsuit brought by a man who claimed he developed mesothelioma cancer from years of exposure to asbestos shipped to his workplace by the defendant. The mesothelioma cancer lawsuit named Union Carbide as the defendant, and was eventually carried on by the victim’s widow after he succumbed to the disease which he claimed was caused by the defendant’s negligence. The road to justice was a long one for the victim and his widow, originally filing the mesothelioma cancer lawsuit in June 2011.

Italian researchers from the University of of Salento in Lecce recently published findings from their study of a potentially groundbreaking mesothelioma cancer treatment that could drastically improve the prognosis of patients with what is considered to be one of the more difficult types of cancer to treat. The study researched how well lab rats with particular mesothelioma tumors responded to two experimental drugs, Ptac2S and cisplatin, and whether either of the two treatments could potentially translate into benefits for human patients.

A recent Duke University study published in The American Journal of Surgical Pathology examined hundreds of women diagnosed with diffuse mesothelioma, looking to an analyzing trends among the group which could eventually shed light on new treatment and detection methods. One of the key findings in the mesothelioma cancer study found that women with objective markers were diagnosed with pleural mesothelioma and that their average age of diagnosis was older compared to those diagnosed with another common type of the cancer, peritoneal mesothelioma.

For purposes of this article, the Navy widow in this case will be referred to as J.G.P., and her late husband as J.E.P. In a recent decision, the Missouri Court of Appeals upheld a $10 million punitive damages award for a Navy widow who lost her husband in 2012 after he developed malignant mesothelioma. Malignant mesothelioma is an aggressive cancer that develops in the mesothelium, which is the tissue layer covering most internal organs. This illness is mainly caused by asbestos exposure, a toxic mineral fiber that was widely used in the 20th century.

Asbestos can remain in the body, seemingly dormant, for a long period of time. As a result, it may be very near the end of the victim’s life before it is clear that exposure to asbestos caused a life-threatening disease. This raises an important question for victims and the families of victims: if the victim predeceases a lawsuit for being exposed to asbestos, what recourse does the victim’s family have?
