The Supreme Court of the State of New York recently denied a petition from Ford Motor Company asking the Court to shut down mesothelioma lawsuit against them.  When the defendant in this case, who for purposes of this article will be referred to as J.S., discovered he had mesothelioma, he and his spouse filed a lawsuit against Ford Motor Company. According to the lawsuit, the company is responsible for J.S.’s exposure to asbestos-containing parts during his years at a dealership in Orchard Park. A New York bankruptcy court finally put to rest an attempt by General Motors Corp. (GM) to recoup money paid to the widow of a former long time Ohio employee who contracted mesothelioma from various GM products over his 37-year career with the auto giant. In addition to filing claims against the victim’s widow, GM attempted to recover funds paid out to the victim’s estate by several asbestos bankruptcy trusts connected to the asbestos contaminated products that allegedly played a role in the deceased auto worker’s condition.
For purposes of this article, the plaintiff in this case will be referred to as A.H.V. Johnson & Johnson, the famous American corporation, has been sued by tens of thousands of people for its talc-based products. According to claimants, the company’s baby powder and other talc products sometimes contained asbestos. Asbestos is a dangerous substance that can cause mesothelioma and other fatal illnesses. Most litigation has been halted during bankruptcy proceedings, but J&J faced a setback after a recent ruling.
New York City’s asbestos courts recently issued new orders expanding the rights of mesothelioma cancer victims to seek enhanced damages from defendants for the harm caused by dangerously designed and manufactured products. The order is a reversal of a previous New York City Asbestos Litigation (NYCAL) declaration that deferred claims for punitive damages indefinitely and deprived mesothelioma victims the opportunity to hold wrongdoers accountable for their indifference to public safety.
According to the CDC, one factor that makes a person more likely to get severely ill with COVID-19 is the presence of an underlying medical condition.
