If you have been diagnosed with mesothelioma or another asbestos-related disease, you might be eligible to file a personal injury claim and seek compensation. One common concern people have is whether they can sue if they are unsure of where or how their asbestos exposure occurred. The good news is that you can still begin the legal process even if you don’t know the exact source(s) of exposure. While a successful claim requires identifying where or how you were exposed, including specific products, job sites, or employers, you do not need all the answers at the outset.
For purposes of this article, the mesothelioma victim in this case will be referred to as T.W. and his wife as J.W. In a recent court decision, a judge denied a defendant’s motion for summary judgment and allowed a widow to proceed with her mesothelioma wrongful death claim. After J.W.’s husband died of malignant mesothelioma, a rare and aggressive form of cancer, she filed a wrongful death claim against the companies she blames for negligently exposing her husband to the asbestos that caused his illness. Among the many companies named in the lawsuit was Crosby Valve, LLC.
The Pacific Meso Center (PMC) at the Pacific Heart, Lung & Blood Institute (PHLBI) will sponsor a UCLA symposium on Lung-Sparing Technologies for Malignant Pleural Mesothelioma. The conference will be the first of its kind focusing on cancer treatments that preserve the victim’s lungs. The symposium will take place on Saturday, May 21st at the Sheraton Delfina in Santa Monica. Malignant Pleural Mesothelioma is an asbestos-related disease that attacks the lining of the chest or the pleura. Mesothelioma also attacks the lining of either the heart, abdomen, or testicles.
From World War II to the 1980s, workers in all facets of the steel industries were unknowingly exposed to high levels of asbestos. Instead of enjoying their “golden years,” many of those men and women are now facing the ordeal of mesothelioma or disabling lung disease. Mesothelioma is an asbestos-related cancer that invades the mesothelium – the lining of tissue that surround vital organs. The most common is pleural mesothelioma or cancer of the lining of the lungs.
For purposes of this article, the mesothelioma victim in this case will be referred to as T.G. In a recent court case, a jury found Johnson & Johnson and two subsidiaries liable in the mesothelioma-related death of T.G., who was a mother of six and a grandmother and awarded the surviving family members $45 million in damages. T.G.’s case and the cases of many others suffered delays when J&J filed bad faith bankruptcies in an attempt to try and avoid liability. These bankruptcy filings stayed litigation in this particular case and thousands of other cases. The lifting of the hold allowed the case of T.G.
By now most of us are familiar with the lawsuits and settlements associated with mesothelioma and other asbestos-related diseases. As victims of asbestos exposure finally get the justice and compensation they deserve, even more are left out to fight on their own as the defendants in these cases continue to deny liability for their dangerous products. Even in the face of overwhelming evidence that an individual exposed to asbestos in his or her everyday life developed the rare, deadly lung disease mesothelioma, manufacturers of the products in question refuse to compensate victims appropriately.
