TRUST PAYMENT REFERENCE
A payment reference for the APG Asbestos Trust, which pays claims for A.P. Green Industries and A.P. Green Refractories asbestos products. Every figure below was checked against the trust's own website, notices, and Trust Distribution Procedures on October 16, 2026.
CURRENT TRUST STATUS
The A.P. Green asbestos trust pays 6.0% of scheduled value. The trustee raised the rate from 5.3% to 6.0% by notice dated April 13, 2026, and claimants who were paid at 5.3% are owed a supplemental payment for the difference. The mesothelioma scheduled value was $165,694 under the trust's last posted inflation notice, dated January 1, 2023, so an Expedited Review mesothelioma claim pays about $9,942 at 6.0%. The TDP requires an inflation adjustment every year, capped at 2.5% from 2024, but the trust has posted no 2024, 2025, or 2026 figure, so the current value may be somewhat higher. Every claim needs A.P. Green exposure before December 31, 1982.
Throneberry Law Group files A.P. Green claims for refractory, steel, and furnace workers and their families across the country. A.P. Green was owned by United States Gypsum until January 2, 1968, so many workers hold claims against both the USG trust and this one, and this page is part of our asbestos trust funds guide, which covers every trust we file against.
PAYMENT REFERENCE
The table below is the short answer. The sections that follow explain each line.
| Current payment percentage | 6.0% of scheduled value for Expedited Review and of the liquidated value for Individual Review. |
|---|---|
| In effect since | April 13, 2026 (Notice of Payment Percentage Increase dated April 13, 2026). The trust's home page still calls 6.0% the "initial" percentage; the notice is the controlling document. |
| Prior rate | 5.3%. The trust has posted no notice dating the 5.3% rate. The initial payment percentage was 4.5% (trust filing instructions). |
| Supplemental payments | Claimants paid at 5.3% receive the difference between their liquidated value times 6.0% and what they were already paid, excluding any sequencing adjustment. Payments under $100 are held and combined with later ones (TDP Section 4.2; notice dated April 13, 2026). |
| Review cycle | The trustee must re-evaluate the payment percentage at least once every three years and may do so sooner (TDP Section 4.2). The last change was April 13, 2026. |
| Mesothelioma scheduled value | $165,694 (Disease Level VII, Notice of Inflation Adjusted Claim Values dated January 1, 2023). The TDP base value is $130,000 (Section 5.3(a)(3)). The TDP calls for a CPI adjustment each year, capped at 2.5% starting in 2024; no later notice is posted. The trust publishes no Individual Review average or maximum. |
| Mesothelioma payout at the current rate | About $9,942 under Expedited Review ($165,694 x 6.0%). Individual Review pays 6.0% of a value set from settlement history in the claimant's state, which can come out above or below the scheduled value. |
| Review options | Expedited Review for Levels I, II, III, IV, VI, and VII. Individual Review only for Lung Cancer 2 (Level V, capped at $15,000 before the percentage), foreign claims, Extraordinary Claims, and Exigent Hardship claims. Claims exposed in Canada count as domestic. |
| Exposure requirement | Meaningful and credible exposure before December 31, 1982 to a product A.P. Green or a predecessor made, sold, or supplied (TDP Section 5.7(b)(3)). Mesothelioma (Level VII) needs A.P. Green exposure only. Levels II, III, IV, and VI need six months of A.P. Green exposure plus Significant Occupational Exposure (five years in an asbestos trade, two of them before December 31, 1982). Level I needs six months plus five years of occupational asbestos exposure. The trust keeps a Qualified Jobsite List of more than 12,000 work sites with the earliest date A.P. Green products are known to have been there (list updated September 1, 2026). |
| Paid USG claim | A claim the USG trust already paid for A.P. Green exposure before January 2, 1968 does not bar an A.P. Green trust claim for the same exposure, and proof of that USG payment may be enough to meet the medical and exposure criteria here (TDP Section 5.3; trust notice on prior USG payments). Level I USG claims and claims that also allege a USG product do not qualify for this shortcut. |
| Filing deadline | For anyone diagnosed after the February 14, 2002 petition date, within three years after diagnosis, or by September 6, 2017, whichever is later, regardless of any state statute of limitations; a longer state limitations period applies if the claimant's state gives one (TDP Section 5.1(a)(2); Claim Filing Deadline Notice dated October 5, 2016). Claims diagnosed before the petition date had to be filed by September 6, 2017. |
| Deemed withdrawn policy | A claim is treated as withdrawn if the claimant neither accepts, rejects, nor starts arbitration within six months of the trust's written offer or rejection (TDP Section 6.3). The trust began enforcing this on outstanding offers on April 1, 2025 (notice dated March 21, 2025). A withdrawn claim must be refiled within three years of the withdrawal or it is barred (TDP Section 6.3, effective January 1, 2025). |
| Sequencing adjustment | A claim that waits a year or more for payment earns an interest-style addition at the one-year Treasury bill rate, capped at 2.5% a year and seven years total, paid at the payment percentage (TDP Section 7.5). |
| Extraordinary Claims | Up to five times the scheduled value for Levels I through IV, VI, and VII, and five times the Individual Review value for Level V, each multiplied by the payment percentage (TDP Section 5.4(a)). For claims where A.P. Green exposure was at least 75% of the total, or came from working in an A.P. Green plant. Individual Review only. |
| Fees | No filing fee. A $50 re-filing fee applies to any claim refiled after a withdrawal, due within 60 days of refiling, effective March 1, 2025 (TDP Section 6.4; notice dated January 1, 2025). The fee is refunded if the claim is allowed and paid. A claim withdrawn for not accepting an offer can be refiled without the fee if the release is later returned (notice dated March 21, 2025). |
| Claims processor | Verus Claims Services. |
| Claims accepted since | March 6, 2014. The Initial Claims Filing Date was September 6, 2014. |
| Trust created | Under the Third Amended Plan of Reorganization of Global Industrial Technologies, Inc. dated December 28, 2005, confirmed February 15, 2013. A.P. Green's parent filed for Chapter 11 on February 14, 2002. The current TDP is the First Amended and Restated APG Asbestos TDP dated November 8, 2013, as amended twelve times through February 27, 2026. |
| Last checked | October 16, 2026, against apg.mfrclaims.com, the conformed TDP as of February 27, 2026, the Claim Filing Instructions, the Qualified Jobsite List updated September 1, 2026, the Protocol for Additions to the Site List, and the trust's notices dated October 5, 2016 (filing deadline), January 1, 2023 (inflation adjusted values), January 1, 2025 (re-filing fee and deadline), March 21, 2025 (outstanding offers), April 13, 2026 (payment percentage increase), and the undated Notice Regarding Prior Payment from the USG Trust. |
SCHEDULE OF DISEASES
The trust sorts asbestos diseases into seven levels. Six carry a fixed scheduled value for Expedited Review. Lung Cancer 2 has no scheduled value and goes through Individual Review only. The TDP sets base values and requires a Consumer Price Index adjustment every year; the trust's last posted adjustment is the notice dated January 1, 2023, and the table shows both.
| Level | Disease | TDP Base Value | 2023 Adjusted Value | ER Payout at 6.0% |
|---|---|---|---|---|
| VII | Mesothelioma | $130,000 | $165,694 | About $9,942 |
| VI | Lung Cancer 1 | $47,000 | $59,906 | About $3,594 |
| V | Lung Cancer 2 | None | None | Individual Review, capped at $15,000 before the percentage |
| IV | Other Cancer | $22,000 | $28,040 | About $1,682 |
| III | Severe Asbestosis | $22,000 | $28,040 | About $1,682 |
| II | Asbestosis / Pleural Disease | $8,300 | $10,580 | About $635 |
| I | Asbestosis / Pleural Disease | $2,750 | $3,504 | About $210 |
The Expedited Review payout is the 2023 adjusted value times 6.0%, rounded. If the trust applied the full 2.5% cap in 2024, 2025, and 2026, the mesothelioma value would now be about $178,400 and the payout about $10,700; the trust has not posted those figures, so this page uses the 2023 notice. The trust publishes no Individual Review average or maximum; Individual Review values come from settlement and verdict history in the claimant's state.
FILING REQUIREMENTS
The trust checks three things on every claim: the disease, the exposure, and the timing. A.P. Green has two things most trusts do not: a job-site list of more than 12,000 locations, and a shortcut for workers the USG trust has already paid.
The claimant must show meaningful and credible exposure before December 31, 1982 to asbestos products that A.P. Green Industries, A.P. Green Refractories, or a predecessor made, sold, installed, or supplied (TDP Section 5.7(b)(3)). The trust accepts an affidavit from the worker, a co-worker, or a family member of a deceased worker, as well as invoices, employment or construction records, and other credible evidence. The trust's Qualified Jobsite List, updated September 1, 2026, names more than 12,000 work sites with the earliest date A.P. Green products are known to have been there; work at a listed site after that date is the usual way to prove exposure. A site that is not on the list can be added by sending the trust evidence of the specific A.P. Green product and dates, under its Protocol for Additions to the Site List, and the trustee decides. Mesothelioma needs A.P. Green exposure only. Levels II, III, IV, and VI also need six months of A.P. Green exposure and Significant Occupational Exposure, which means five years in a trade that handled, cut, or worked next to asbestos products, with at least two of those years before December 31, 1982.
A worker the USG trust already paid for A.P. Green exposure before January 2, 1968 (a Paid USG/A.P. Green Claim) can file here too. That payment does not bar the A.P. Green claim, and proof of it may be enough, in the trust's discretion, to satisfy the medical and exposure criteria without starting over. The shortcut covers USG claims at Levels II and up that were paid on A.P. Green site exposure alone; it does not cover Level I claims or claims that also alleged a USG product.
A mesothelioma claim needs a diagnosis of mesothelioma, usually a pathology report. Every claim also needs a doctor's statement, or a work history, showing at least ten years between first asbestos exposure and diagnosis. Lower levels require the medical findings the TDP lists for that level. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.
For anyone diagnosed after February 14, 2002, the TDP's own deadline is three years after diagnosis, and it applies regardless of any state statute of limitations (TDP Section 5.1(a)(2)); if the claimant's state allows longer, the longer period applies. The second clock matters once a claim is filed. If the trust makes an offer and the claimant neither accepts, rejects, nor starts arbitration within six months, the claim is deemed withdrawn, and the trust has enforced that rule on outstanding offers since April 1, 2025. A withdrawn claim can be refiled within three years, with a $50 re-filing fee that is refunded when the claim is paid, but it goes to the back of the line. A claimant who needs time can instead ask the trust to defer the claim for up to three years and keep their place in the queue. We file soon after diagnosis and we answer every offer well inside six months.
Expedited Review pays the scheduled value times the payment percentage once the claim meets the level's medical and exposure criteria. For mesothelioma that is about $9,942 at 6.0%. Individual Review sets a value from the settlement and verdict history for similar claims in the claimant's state, considering age, dependents, earnings, and how much of the exposure was A.P. Green's, and the TDP warns that the result can be lower than the scheduled value. Lung Cancer 2 claims, foreign claims, and Extraordinary Claims must use Individual Review. An Extraordinary Claim, where at least 75% of the worker's exposure was to A.P. Green products or came from working in an A.P. Green plant, can be valued at up to five times the scheduled value (TDP Section 5.4(a)), which for mesothelioma is about $828,000 before the percentage and about $49,700 after it. We compare both routes before filing.
RATE HISTORY
The trust's filing instructions record the initial payment percentage at 4.5%, set after the trust opened in 2014. At some point the trustee raised it to 5.3%; the trust has posted no notice dating that change. By notice dated April 13, 2026 the trustee, with the consent of the Trust Advisory Committee and the Future Claimants' Representative, raised the rate from 5.3% to 6.0% and ordered supplemental payments to everyone who had been paid at 5.3%. The trust's home page still describes 6.0% as the initial percentage, which is a labeling error, not a second rate.
A.P. Green is one of the few trusts whose rate has gone up rather than down. Two other changes affect what a claim is worth. The scheduled values rise with inflation each year under TDP Section 5.3(a)(3), capped at 2.5% a year since 2024, and the last posted adjustment (January 1, 2023) lifted the mesothelioma value from $130,000 to $165,694. And since January 1, 2025 the trust has enforced a three-year refiling window for withdrawn claims, with a $50 re-filing fee from March 1, 2025 and a six-month deemed-withdrawal rule on open offers from April 1, 2025.
PRODUCTS AND WORK SITES
A.P. Green Industries and A.P. Green Refractories made heat-resistant brick, castables, mortars, and insulating cements for furnaces, boilers, kilns, and ladles. The trust publishes no product list. It defines covered exposure by company instead: any asbestos product that A.P. Green, a subsidiary, or a predecessor made, sold, installed, specified, or supplied before December 31, 1982 (TDP Section 5.7(b)(3)). The trust's Qualified Jobsite List does the work a product list would do elsewhere, and a claim is usually proved one of three ways.
Those products went into steel mills, foundries, power plants, refineries, and glass and cement plants. Bricklayers and refractory masons, boilermakers, furnace crews, steelworkers, and the plant workers around them breathed the dust. The same work history usually supports claims against the other refractory trusts, such as NARCO, Kaiser Aluminum, and Harbison-Walker, and for pre-1968 exposure the USG trust as well.
QUESTIONS
As of October 16, 2026, the APG Asbestos Trust pays 6.0% of scheduled value. The trustee raised the rate from 5.3% to 6.0% by notice dated April 13, 2026, and claimants who were paid at 5.3% receive a supplemental payment for the difference.
The mesothelioma scheduled value was $165,694 under the trust's inflation notice dated January 1, 2023, and the TDP adjusts it each year by up to 2.5%. At the current 6.0% rate, an Expedited Review claim pays about $9,942. An Extraordinary Claim can be valued at up to five times the scheduled value.
Usually not. For anyone diagnosed after February 14, 2002, the trust's own deadline is three years after diagnosis, and the TDP applies it regardless of state statutes of limitations. The exposure must have happened before December 31, 1982, and an offer left unanswered for six months is treated as withdrawn, so the safest step is to file soon after diagnosis and respond to the trust promptly.
WHY THRONEBERRY LAW
An A.P. Green claim is worth filing for three reasons that most summaries miss: the rate just went up, the scheduled value rises with inflation, and a worker already paid by the USG trust for pre-1968 A.P. Green exposure can use that payment as proof here. We check the Qualified Jobsite List and the USG record for every refractory client before we file, and we file the other refractory trusts on the same proof. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
