Durabla Asbestos Trust Payment Percentage, Scheduled Values, and Filing Rules

A payment reference for the Durabla Manufacturing Company and Durabla Canada Ltd. Asbestos Trust, which was set up to pay claims for asbestos products supplied, specified, manufactured, installed, maintained, or repaired by Durabla Manufacturing Company or Durabla Canada Ltd. Every figure below was checked against the trust's own Trust Distribution Procedures, notices, claim form, and filing instructions on October 18, 2026.

The Durabla asbestos trust has not paid a claim and has not announced a payment percentage. The trust opened for filing on September 8, 2020 under an amended TDP that created a three-and-a-half-year Initial Intake Period, during which no claim would be processed or paid. That period ended March 8, 2024. The trust said it would then set the payment percentage and build its claims procedures with its processor, and as of October 18, 2026 it has posted no payment percentage, no processing start date, and no notice since a revised claim form dated August 2024. The TDP lists a 26% Initial Payment Percentage, but the trust's own notices say the rate will be determined after intake, so that figure has never been applied. The mesothelioma scheduled value is $7,000, the smallest of any trust we file against, with an $8,000 Individual Review average and a $15,000 maximum.

Throneberry Law Group files Durabla claims to protect the statute of limitations for clients whose work history supports them, and we tell every client what this page says: the trust is small, it has not started paying, and the eventual payment will be modest. This page is part of our asbestos trust funds guide, which covers every trust we file against, including the far larger trusts that the same work history usually supports.

PAYMENT REFERENCE

Durabla Trust Payment Reference

The table below is the short answer. The sections that follow explain each line.

Current payment percentageNone announced. The trust's Initial Intake Notice and its February 12, 2024 update state that no claims would be processed or paid during the Initial Intake Period and that the trust would determine the payment percentage at the end of that period. The trust has posted no payment percentage since the period ended March 8, 2024.
Initial Intake PeriodSeptember 8, 2020 through the close of business March 8, 2024 (trust update dated February 12, 2024). During the period the trust accepted claims for filing only, with a minimal data set sufficient to toll the statute of limitations, and recorded an SOL tolling date for each claim.
TDP Initial Payment Percentage26% (TDP Section 2.3), calculated on the assumption that the TDP's Average Values would be achieved. The trust's notices say the rate will be set after intake, so 26% is the TDP's starting figure, not a rate the trust has adopted or applied. If the trust did apply 26%, a $7,000 mesothelioma claim would pay $1,820; that is arithmetic on the TDP figure, not a prediction.
Review cycleOnce set, the trustee must reconsider the payment percentage at least once every three years, starting the first January 1 after the Effective Date, and may change it with the consent of the TAC and the Legal Representative (Section 4.2). Supplemental payments follow if the rate rises (Section 4.3).
Inflation adjustmentNone in the TDP. The TDP provides a sequencing adjustment at the one-year Treasury bill rate for claims that wait more than a year for payment after entering the review queue (Section 7.5); whether and how that applies to intake-period claims is not addressed in any posted notice.
Mesothelioma scheduled value$7,000 scheduled; $8,000 Individual Review average; $15,000 Individual Review maximum (Section 5.3(b)(3)).
Mesothelioma payout at the current rateCannot be computed. No payment percentage has been set.
Review optionsExpedited Review pays the scheduled value times the payment percentage once the claim meets the medical and exposure criteria (Section 5.3(a)). Individual Review values the claim on the law of the claimant's jurisdiction and the trust's factors, up to the maximum (Section 5.3(b)). Lung Cancer 2 (Level V), Foreign Claims, Extraordinary Claims, and secondary exposure claims must go through Individual Review.
Extraordinary ClaimsDisease Levels I through VII. A claimant whose exposure occurred predominantly while working in a Durabla manufacturing facility while it made asbestos products, or was at least 75% the result of exposure to a Durabla product or conduct, with little likelihood of a substantial recovery elsewhere, can be awarded up to five times the scheduled value (five times the average value for Level V), times the payment percentage (Section 5.4(a)). For mesothelioma that is up to $35,000 before the payment percentage. A special Extraordinary Claims Panel decides disputes.
Exposure requirementDebtor Exposure (the claim form calls it Durabla Exposure): meaningful and credible exposure before December 31, 1982 to asbestos or asbestos products supplied, specified, manufactured, installed, maintained, or repaired by Durabla Manufacturing Company or Durabla Canada Ltd., or an entity either is legally responsible for (Section 5.7(b)(3)). Mesothelioma needs Debtor Exposure only. Lung Cancer 1, Other Cancer, and Severe Asbestosis need six months of Debtor Exposure before December 31, 1982 plus Significant Occupational Exposure (five cumulative years in an asbestos trade, at least two before December 31, 1982). Proof may be an affidavit of the claimant, a co-worker, or (for a deceased claimant) a family member, invoices, employment or construction records, or other credible evidence.
Filing deadlineAnyone first diagnosed after the Petition Date (December 15, 2009 for Durabla Manufacturing Company; November 8, 2010 for Durabla Canada Ltd.) may file within three years after diagnosis or within three years after the Initial Claims Filing Date, whichever is later, regardless of any state statute of limitations (Section 5.1(a)(3)). The trust's February 12, 2024 update told filers that a claim filed to toll the statute of limitations had to be filed by the close of business March 8, 2024, which matches three years after a March 8, 2021 Initial Claims Filing Date (six months after the September 8, 2020 opening). For a diagnosis today, the deadline is three years from the diagnosis date.
Fees and withdrawal rulesNo fee has been charged. The TDP leaves a fee to the trustee's discretion (Section 6.4) and every trust notice since 2020 says a claims processing fee "may be required" before any filed claim is processed. A claimant may defer processing and keep the queue position.
Claims processorClaims Resolution Management Corporation (CRMC), 3120 Fairview Park Drive, Suite 200, Falls Church, Virginia 22042, selected September 8, 2020, through the CRMC eClaims system (eClaims Filer Agreement and User Administrator Form required). Questions go to inquiry@claimsres.com.
Trust createdUnder the Joint Chapter 11 Plan of Reorganization for Durabla Manufacturing Company and Durabla Canada Ltd. dated June 29, 2011. Durabla Manufacturing Company filed its petition December 15, 2009 and Durabla Canada Ltd. on November 8, 2010; the Plan was first filed November 8, 2010. The trust began accepting claims September 8, 2020 under the 2020 TDP, which added the Initial Intake Period.
Last checkedOctober 18, 2026, against durablatrust.org (About, Announcements, Documents, and Contact pages), the CRMC Durabla announcements and documents pages at claimsres.com, the Durabla Trust Distribution Procedures (2020), the Initial Intake Notice, the claim form instructions dated May 19, 2020, the Proof of Claim Form (Version 2, August 2024), and the trust update dated February 12, 2024.

SCHEDULE OF DISEASES

Scheduled Values by Disease Level

The Durabla TDP uses seven disease levels, not the eight most trusts use; mesothelioma is Level VII and the two non-malignant levels are I and II. Lung Cancer 2 (Level V) has no scheduled value and goes through Individual Review only. No payout column appears because the trust has not set a payment percentage.

LevelDiseaseScheduled ValueIR AverageIR Maximum
VIIMesothelioma$7,000$8,000$15,000
VILung Cancer 1$3,500$4,000$7,000
VLung Cancer 2None (Individual Review only)$1,200$2,500
IVOther Cancer$1,100$1,200$2,500
IIISevere Asbestosis$3,500$4,000$7,000
IIAsbestosis / Pleural Disease$900NoneNone
IAsbestosis / Pleural Disease$500NoneNone

These are the smallest scheduled values of any trust on this site. Whatever payment percentage the trust eventually sets, a mesothelioma claim will pay a fraction of $7,000 under Expedited Review and no more than a fraction of $15,000 under Individual Review. We file Durabla because the claim costs the client nothing extra once the exposure history is built for the other trusts, not because it will change the outcome of a case.

FILING REQUIREMENTS

What a Durabla Trust Claim Must Show

Until the trust starts processing, a filing does one thing: it tolls the statute of limitations and holds a place in line. The trust's 2024 update says only a minimal data set is required to file, and the trust records an SOL tolling date when the data is saved. When processing begins, the trust will check the disease, the exposure, and the timing against the TDP.

Exposure to Durabla Products

The claimant must show meaningful and credible exposure, before December 31, 1982, to asbestos or asbestos products supplied, specified, manufactured, installed, maintained, or repaired by Durabla Manufacturing Company or Durabla Canada Ltd., or an entity either company is legally responsible for (TDP Section 5.7(b)(3)). The trust accepts a sworn statement of the injured person or a co-worker, a sworn statement of a family member when the claimant has died, invoices, employment or construction records, or other credible evidence, and it can ask for more. The claim form asks for each exposure period with the site, dates, occupation and industry codes, and the Durabla products involved. Mesothelioma needs Debtor Exposure only. Lung Cancer 1, Other Cancer, and Severe Asbestosis also need six months of Debtor Exposure before December 31, 1982 and Significant Occupational Exposure, which means at least five cumulative years, two of them before December 31, 1982, in an industry and occupation that handled raw asbestos, fabricated asbestos products, worked with asbestos products, or worked regularly alongside those who did (Section 5.7(b)(2)). Take-home (secondary) exposure claims go through Individual Review.

Medical Proof

A mesothelioma claim needs a diagnosis of mesothelioma. Lung Cancer 1 and Other Cancer (colorectal, laryngeal, esophageal, pharyngeal, or stomach) need the cancer diagnosis plus evidence of an underlying Bilateral Asbestos-Related Nonmalignant Disease (a B-read of 1/0 or higher, or an x-ray, CT, or pathology report by a qualified physician showing bilateral disease) and medical documentation that asbestos exposure contributed to the cancer. Severe Asbestosis needs an ILO reading of 2/1 or higher or pathology, plus TLC under 65% or FVC under 65% with an FEV1/FVC ratio over 65%. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.

Deadlines

Anyone first diagnosed after the Petition Date may file within three years after diagnosis, regardless of the state statute of limitations (Section 5.1(a)(3)). The alternative deadline, three years after the Initial Claims Filing Date, ran out on March 8, 2024 according to the trust's own update, so for a diagnosis today the deadline is three years from the diagnosis date. Claims diagnosed before the Petition Date had to be filed by March 8, 2024 if they were pending against a Durabla company, tolled, or still within the statute of limitations on the Petition Date. Because the trust has not announced when processing will start or whether a fee will be charged, we file as soon as the exposure is confirmed and watch the trust's announcements page for the next notice.

Expedited Review, Individual Review, or Extraordinary Claim

When processing begins, Expedited Review will pay the $7,000 mesothelioma scheduled value times the payment percentage; Individual Review will value the claim on the law of the claimant's jurisdiction and the trust's factors, up to $15,000, with the average set at $8,000; and an Extraordinary Claim, for a worker exposed predominantly in a Durabla plant or whose exposure was at least 75% Durabla product, can reach five times the scheduled value, $35,000 before the payment percentage (Section 5.4(a)). A claimant who rejects the trust's offer can go to arbitration under the trust's ADR procedures and, after non-binding arbitration, to the tort system.

RATE HISTORY

Why the Durabla Trust Has No Payment Percentage Yet

The TDP set an Initial Payment Percentage of 26% (Section 2.3). Before the trust opened, the trustee amended the TDP with the consent of the Trust Advisory Committee and the Future Claimants' Representative to add an Initial Intake Period, because, in the trust's words, it faced great uncertainty about both the number and severity of claims and the assets available to pay them. The trust began accepting claims on September 8, 2020, took filings for three and a half years, and processed and paid nothing. The period ended March 8, 2024.

The trust's February 12, 2024 update said that once the payment percentage was determined, the trust would work with CRMC to develop its policies and procedures and modify the eClaims system for Durabla claims, and that it would keep filers updated on the CRMC website. Since then the trust has posted a revised Proof of Claim Form (Version 2, August 2024) and nothing else: no payment percentage, no processing start date, no fee notice. This page will be updated when the trust posts its rate.

PRODUCTS AND WORK SITES

Durabla Products and Who Was Exposed

The trust's procedures define covered exposure by company, as asbestos products supplied, specified, manufactured, installed, maintained, or repaired by Durabla Manufacturing Company or Durabla Canada Ltd., or an entity either is legally responsible for (TDP Section 5.7(b)(3)). The trust publishes no product list and no site list, and its claim form asks the claimant to name the Durabla products and the sites. Proof for the trust comes from two directions.

  • A witness who can name the product: a sworn statement from the injured person or a co-worker, or from a family member when the injured person has died, that a Durabla product was handled, installed, removed, or disturbed on the job before December 31, 1982, with dates and locations.
  • Documents: invoices, employment, construction, or similar records that place Durabla product at the site.

The firm evaluates Durabla exposure alongside the rest of a client's industrial work history. A pipefitter's, boilermaker's, or plant maintenance worker's history that supports a Durabla claim usually supports larger claims against trusts such as Garlock, Federal-Mogul, and Babcock & Wilcox, and those trusts are where the recovery comes from. Our page on products that contained asbestos explains how industrial asbestos products released fiber.

QUESTIONS

Frequently Asked Questions About the Durabla Trust

What is the current Durabla trust payment percentage?

As of October 18, 2026, the Durabla Manufacturing Company and Durabla Canada Ltd. Asbestos Trust has not announced a payment percentage and has not paid any claim. The trust took filings during an Initial Intake Period from September 8, 2020 to March 8, 2024 without processing them, said it would set the payment percentage after that period, and has posted no rate since. The TDP's 26% Initial Payment Percentage has never been applied.

How much does the Durabla trust pay for mesothelioma?

Nothing yet, because no payment percentage has been set. The mesothelioma scheduled value is $7,000, with an $8,000 Individual Review average and a $15,000 maximum, and an Extraordinary Claim can reach $35,000 before the payment percentage. Whatever rate the trust sets will be applied to those figures, so the eventual payment will be small.

Is it too late to file a Durabla trust claim?

Usually not for a recent diagnosis. Anyone first diagnosed after the Petition Date (December 15, 2009 for Durabla Manufacturing Company) may file within three years after diagnosis regardless of the state statute of limitations. The trust's alternative deadline of March 8, 2024 has passed, so older claims not filed by then are late. The trust still accepts filings through CRMC's eClaims system and records a statute of limitations tolling date for each one.

WHY THRONEBERRY LAW GROUP

Why File Your Durabla Claim With Throneberry Law Group

Durabla is a trust that has not paid anyone in six years of operation and will pay little when it does. A firm that oversells it is not being straight with you. We file Durabla for one reason: when a client's work history supports it, the claim costs nothing extra to file once the exposure proof is built for the other trusts, and filing now tolls the statute of limitations so the client is in line whenever the trust starts paying. We tell clients what the values are, we do not let a Durabla filing delay the trusts that matter, and we watch the trust's announcements so the claim is completed when processing opens. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.

We work on contingency, so you pay nothing unless we recover money for you. We serve clients nationwide, we can help Spanish-speaking families, and we travel to you, including to your home or hospital.
