Duro Dyne Asbestos Trust Payment Percentage, Scheduled Values, and Filing Rules

A payment reference for the Duro Dyne Asbestos Personal Injury Trust, which pays claims for asbestos exposure from direct work with Duro Dyne asbestos-containing flexible duct connectors, the only asbestos product the trust believes it is responsible for. Every figure below was checked against the trust's own Trust Distribution Procedures, amendments, notices, claim form instructions, and 2026 scheduled values on October 18, 2026.

The Duro Dyne asbestos trust pays 20% of a claim's scheduled value, and the trustee has proposed doubling it. On July 10, 2026 the trust gave notice under TDP Section 4.3 that the trustee is reconsidering the payment percentage and that the proposed rate is 40%; as of October 18, 2026 the trust's home page still lists 20% and no adoption notice has been posted. A mesothelioma claim carries a $147,141 scheduled value for 2026, after the trust's 1% annual increase, so it pays about $29,428 at 20% and would pay about $58,856 if the 40% proposal is adopted. Duro Dyne is a narrow trust: the claimant must have worked in one of eight Qualifying Occupations in the sheet metal, HVAC, duct, and furnace trades and must show direct work with Duro Dyne flexible duct connectors, and there is no Individual Review track. Every claim needs a $50 filing fee within 60 days or it is not treated as filed.

Throneberry Law Group files Duro Dyne claims for sheet metal workers, HVAC installers and technicians, duct installers, and furnace installers, and their families, across the country. This page is part of our asbestos trust funds guide, which covers every trust we file against. Our Duro Dyne Corporation company page covers the company's history.

PAYMENT REFERENCE

Duro Dyne Trust Payment Reference

The table below is the short answer. The sections that follow explain each line.

Current payment percentage20% of the scheduled value for all five disease levels (trust home page; Notice Regarding Payment Percentage dated July 10, 2026).
Proposed increase40%. The July 10, 2026 notice states that the trustee is reconsidering the payment percentage under TDP Section 4.3 and that the proposed rate is 40%, subject to the consent of the Trust Advisory Committee and the Future Claimants' Representative. The trust has posted no adoption notice as of October 18, 2026. When a higher rate is adopted, claimants paid at the lower rate receive supplemental payments under TDP Section 4.3.
Prior rates20% has been the rate since the trust opened; the trust's home page calls it the Initial Payment Percentage, and the trust has posted no other rate change.
Review cycleThe trustee must reconsider the payment percentage at least once every three years, starting the first January 1 after the Effective Date, and at least once every twelve months in the trust's early years, and may change it with the consent of the TAC and the FCR (Section 4.2).
Inflation adjustmentYes. The scheduled values rise 1% each year starting January 1, 2022, and the increase applies to offers made after each increase date (Section 5.3(a)(3)). The 2026 values are posted in the trust's Notice of 2026 Scheduled Values. The trust also pays a sequencing adjustment (interest-like) on claims delayed by the trust or its processor (Section 7.5, as rewritten by the Second Amendment effective August 11, 2023).
Mesothelioma scheduled value$147,141 (effective January 1, 2026). The TDP's base value was $140,000. There is no Individual Review average or maximum; the Duro Dyne TDP has no Individual Review track.
Mesothelioma payout at the current rateAbout $29,428 ($147,141 x 20%). If the proposed 40% is adopted, about $58,856.
Review optionsExpedited Review only. A valid claim is paid the scheduled value for its disease level times the payment percentage (Section 5.3(a)). Disputes go to the trust's ADR procedures and, after non-binding arbitration, to the tort system (Sections 5.8 and 5.9). Secondary (take-home) exposure claims must show the occupationally exposed person would have met the trust's exposure rules (Section 5.4).
Extraordinary ClaimsNone. The Duro Dyne TDP has no Extraordinary Claim provision.
Exposure requirementDebtor Exposure: meaningful and credible exposure to asbestos, asbestos products, or conduct for which the trust is responsible (Section 5.6(b)(3)). The TDP then narrows it two ways. The injured party must have worked in a Qualifying Occupation: sheet metal mechanic, sheet metal worker, sheet metal apprentice, HVAC repairman, HVAC installer, HVAC technician, duct installer, or furnace installer (Section 5.6(b)(3)(A)). And the injured party must show, to the trust's satisfaction, direct work with Duro Dyne asbestos-containing flexible duct connectors, judged against the circumstances of the claims the company historically paid (Section 5.6(b)(3)(B)). A claimant outside the Qualifying Occupations may still present proof of direct exposure for the trust's consideration (Section 5.6(b)(3)(C)). Mesothelioma needs Debtor Exposure only; the other four levels need six months of Debtor Exposure plus Significant Occupational Exposure (five cumulative years in an asbestos trade). The TDP sets no exposure cutoff date. Proof may be an affidavit of the claimant, a co-worker, or (for a deceased claimant) a family member, invoices, employment or construction records, or other credible evidence.
Filing deadlineAnyone first diagnosed after September 7, 2018 (the Petition Date) may file within three years after diagnosis or by March 20, 2025, whichever is later, regardless of any state statute of limitations (Section 5.1(a)(2); Claims Filing Deadlines letter dated February 5, 2024). Claims diagnosed before September 7, 2018 were timely only if they were pending, tolled, or still within the statute of limitations on the Petition Date and were filed by March 20, 2025.
Fees and withdrawal rules$50 filing fee on every claim (TDP Section 6.4; Notice of Claim Filing Requirements and Fee), refunded in full to a claimant who accepts and is paid a settlement offer. A claim is not deemed filed until the fee arrives, is held on administrative hold without it, and is rejected with no tolling of the statute of limitations if the fee is not received within 60 days of the trust's receipt of the claim. A claim cannot be deferred until the fee is paid.

Trust createdUnder the Third Amended Prenegotiated Plan of Reorganization for Duro Dyne National Corp. and its affiliates (Duro Dyne Corporation, Duro Dyne West Corp., Duro Dyne Midwest Corp., and Duro Dyne Machinery Corp.), jointly administered as Case No. 18-27963 in the United States Bankruptcy Court for the District of New Jersey, confirmed by order entered October 16, 2020 and affirmed by the District Court on October 23, 2020. The Petition Date was September 7, 2018. The TDP has been amended twice: a filing fee amendment and the Second Amendment (sequencing adjustment) effective August 11, 2023.
Last checkedOctober 18, 2026, against durodyne.mfrclaims.com (home, Resources, and Contact Us pages), the Duro Dyne Trust Distribution Procedures, the Second Amendment to the TDP effective August 11, 2023, the Notice Regarding Payment Percentage dated July 10, 2026, the Notice of 2026 Scheduled Values, the Claims Filing Deadlines letter dated February 5, 2024, the Notice of Claim Filing Requirements and Fee, and the Claim Form Instructions.

SCHEDULE OF DISEASES

Scheduled Values by Disease Level

The Duro Dyne TDP uses five disease levels, numbered from Severe Asbestosis (Level I) up to Mesothelioma (Level V), with no non-malignant pleural levels. Every level has a scheduled value and Lung Cancer 2 is paid on a schedule rather than individually reviewed. The values below are the 2026 values from the trust's notice, after five 1% annual increases on the TDP's base figures.

LevelDiseaseBase Value (TDP)2026 Scheduled ValuePayout at 20%Payout at proposed 40%
VMesothelioma$140,000$147,141About $29,428About $58,856
IVLung Cancer 1$50,000$52,550About $10,510About $21,020
IIILung Cancer 2$25,000$26,276About $5,255About $10,510
IIOther Cancer$20,000$21,020About $4,204About $8,408
ISevere Asbestosis$34,000$35,734About $7,147About $14,294

The payout columns are the 2026 scheduled value times 20%, and times the proposed 40%, rounded. The 40% column is arithmetic on the trust's July 10, 2026 proposal, not a rate the trust has adopted. Among the narrow-product trusts, Duro Dyne is one of the better payers for the workers it covers, and a sheet metal worker's mesothelioma claim is worth building carefully.

FILING REQUIREMENTS

What a Duro Dyne Trust Claim Must Show

The trust checks the disease, the occupation, the product, the timing, and the fee. The occupation and product rules are stricter than at most trusts, and the fee rule has teeth.

Qualifying Occupation and Direct Work With Duro Dyne Flexible Duct Connectors

Because of the nature of the company's business, the TDP says there is a limited universe of occupations in which workers were likely to be directly exposed, and it lists them: sheet metal mechanic, sheet metal worker, sheet metal apprentice, HVAC repairman, HVAC installer, HVAC technician, duct installer, and furnace installer (TDP Section 5.6(b)(3)(A)). The trust may add or remove occupations. The injured party must also show, to the trust's satisfaction, that he or she worked directly with Duro Dyne asbestos-containing flexible duct connectors, judged by whether the circumstances match the claims the company historically paid (Section 5.6(b)(3)(B)). The trust's filing instructions state that flexible duct connectors are the only asbestos product the trust believes it is responsible for, and that a claimant may try to prove others exist. A worker outside the listed occupations may present proof of direct exposure for the trust's consideration and, if approved, receives the full scheduled value (Section 5.6(b)(3)(C)). The trust accepts a sworn statement of the injured person or a co-worker, a sworn statement of a family member when the claimant has died, invoices, employment or construction records, or other credible evidence, and it can ask for more. Mesothelioma needs Debtor Exposure only. Lung Cancer 1 and 2, Other Cancer, and Severe Asbestosis also need six months of Debtor Exposure and Significant Occupational Exposure, which means at least five cumulative years in an industry and occupation that handled raw asbestos, fabricated asbestos products, worked with asbestos products, or worked regularly alongside those who did (Section 5.6(b)(2)). Take-home (secondary) exposure claims must show the occupationally exposed person would have met these rules (Section 5.4). The TDP sets no exposure cutoff date.

Medical Proof

A mesothelioma claim needs a diagnosis of mesothelioma. Lung Cancer 1 and Other Cancer need the cancer diagnosis plus evidence of an underlying Bilateral Asbestos-Related Nonmalignant Disease (a B-read of 1/0 or higher, or an x-ray, CT, or pathology report by a qualified physician showing bilateral disease) and medical documentation that asbestos exposure contributed to the cancer. Lung Cancer 2 is a lung cancer that does not meet the Lung Cancer 1 criteria. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.

Deadlines and the Fee

Anyone first diagnosed after September 7, 2018 may file within three years after diagnosis, regardless of the state statute of limitations (Section 5.1(a)(2)). The alternative deadline of March 20, 2025 has passed, so for a diagnosis today the deadline is three years from the diagnosis date. Claims diagnosed before September 7, 2018 had to be filed by March 20, 2025 if they were pending against a Duro Dyne company, tolled, or still within the statute of limitations on the Petition Date (letter dated February 5, 2024). The $50 filing fee must arrive within 60 days of the trust's receipt of the claim; until it does the claim sits on administrative hold, is not deemed filed, and cannot be deferred, and if it never arrives the claim is rejected and the statute of limitations is not treated as tolled. The fee is refunded when the claimant accepts and is paid an offer. We send the fee with the claim.

Expedited Review and Disputes

Duro Dyne has no Individual Review and no Extraordinary Claim track. A valid claim is paid the scheduled value times the payment percentage, about $29,428 for mesothelioma at 20% and about $58,856 if the proposed 40% is adopted. A claimant who disputes the trust's decision can go to arbitration under the trust's ADR Procedures and, after non-binding arbitration, to the tort system (Sections 5.8 and 5.9).

RATE HISTORY

How the Duro Dyne Payment Percentage Has Changed

The trust's home page states that the Initial Payment Percentage is 20% and is subject to revision under the TDP, and the trust has posted no change since it opened. The TDP requires the trustee to reconsider the rate at least every three years and, in the trust's early years, at least every twelve months, with the consent of the Trust Advisory Committee and the Future Claimants' Representative (Section 4.2).

On July 10, 2026 the trust gave notice that the trustee is reconsidering the payment percentage under Section 4.3, that the rate currently applied is 20%, and that the proposed rate is 40%. The notice does not give an effective date, and as of October 18, 2026 the trust has posted no adoption notice and its home page still lists 20%. Under Section 4.3, if a higher rate is adopted, claimants paid at 20% receive supplemental payments to bring them up to the new rate. The trust posts no annual report on its website, so this page carries no claims-paid totals.

PRODUCTS AND WORK SITES

Duro Dyne Products and Who Was Exposed

The trust is built around one product. Its filing instructions say that, based on the company's history, the trust believes flexible duct connectors are the only asbestos-containing product it is responsible for, and the TDP names the eight occupations likely to have worked directly with them: sheet metal mechanics, workers, and apprentices, HVAC repairmen, installers, and technicians, duct installers, and furnace installers. The TDP notes that the company historically resolved only a few dozen asbestos cases a year nationwide. The trust publishes no site list. Proof for the trust comes from two directions.

  • A witness who can describe the work: a sworn statement from the injured person or a co-worker, or from a family member when the injured person has died, that the worker cut, fitted, installed, or removed Duro Dyne flexible duct connectors on ductwork and HVAC jobs, with dates, locations, and the job title that puts the worker in a Qualifying Occupation.
  • Documents: union records, employment or construction records, invoices, or other records that place the worker in the sheet metal or HVAC trade and Duro Dyne product on the job.

The firm sees Duro Dyne exposure among sheet metal workers and HVAC mechanics in the construction trades, and the same ductwork and mechanical-room history usually supports claims against the insulation, gasket, and building-material trusts, including Garlock, USG, and W.R. Grace. Our Duro Dyne Corporation company page covers the company's history, and our page on products that contained asbestos explains how these materials released fiber.

QUESTIONS

Frequently Asked Questions About the Duro Dyne Trust

What is the current Duro Dyne trust payment percentage?

As of October 18, 2026, the Duro Dyne Asbestos Personal Injury Trust pays 20% of a claim's scheduled value, the rate it has used since it opened. On July 10, 2026 the trustee gave notice that the rate is under reconsideration and that the proposed rate is 40%, subject to the consent of the Trust Advisory Committee and the Future Claimants' Representative. The trust has not yet posted an adoption notice.

How much does the Duro Dyne trust pay for mesothelioma?

The 2026 mesothelioma scheduled value is $147,141, so a valid claim pays about $29,428 at 20% and would pay about $58,856 if the proposed 40% is adopted. The values rise 1% each January. The trust has no Individual Review or Extraordinary Claim track; every valid claim is paid the scheduled value times the payment percentage.

Is it too late to file a Duro Dyne trust claim?

Usually not for a recent diagnosis. Anyone first diagnosed after September 7, 2018 may file within three years after diagnosis regardless of the state statute of limitations. The trust's alternative deadline of March 20, 2025 has passed, so claims diagnosed before September 7, 2018 and not filed by then are late. A claim is not treated as filed until its $50 fee arrives, within 60 days.

WHY THRONEBERRY LAW GROUP

Why File Your Duro Dyne Claim With Throneberry Law Group

Duro Dyne pays well for the workers it covers and nothing for anyone else. A firm that files a pipefitter's or laborer's claim here gets a denial and loses the fee; a firm that files a sheet metal worker's claim without describing the duct connector work gets the same result. We file Duro Dyne for sheet metal and HVAC clients because the claim pays a meaningful amount at 20% and twice that if the proposed 40% is adopted, because the proof is the client's own trade history, and because the fee comes back when the claim pays. We put the Qualifying Occupation and the flexible duct connector work in the affidavit, send the $50 fee with the claim, and calendar the 60-day fee deadline. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
