TRUST PAYMENT REFERENCE
A payment reference for the NGC Bodily Injury Trust, which pays claims for asbestos products made or sold by the old National Gypsum Company under its name and its Gold Bond brand. Every figure below was checked against the trust's own Claims Resolution Procedures, claim filing instructions, notices, Restated Exposure Policies, product list, and site list on October 18, 2026.
CURRENT TRUST STATUS
The National Gypsum asbestos trust pays 45% of a claim's Allowed Liquidated Value. The trustees raised the rate from 40% to 45% effective January 19, 2023 and, at the same time, adopted a 2% annual inflation adjustment to the baseline values. A mesothelioma claim carries a $45,000 baseline value for Individual Review and a $22,500 value for Expedited Review, so an Expedited Review mesothelioma claim pays about $10,125 before the inflation adjustment. The trust's own FAQ page still says 40%; the January 19, 2023 notice on its Notices page controls. Living mesothelioma claimants are treated as exigent and go to the front of the processing line.
Throneberry Law Group files National Gypsum claims for plasterers, drywall finishers, painters, carpenters, school and hospital maintenance workers, and the families of people who worked in buildings with Gold Bond acoustical plaster. This page is part of our asbestos trust funds guide, which covers every trust we file against. The trust's values are small, but its Public Site List names 67 Illinois and 33 Missouri buildings, most of them schools and churches, and a listed building carries the exposure proof.
PAYMENT REFERENCE
The table below is the short answer. The sections that follow explain each line.
| Current payment percentage | 45% of the Allowed Liquidated Value (ALV), applied to every disease category. The trust calls it the Payment Sum Percentage (PSP). |
|---|---|
| In effect since | January 19, 2023 (notice "NGCBIT PSP Increase to 45% and ALV Inflation Adjustment" dated January 19, 2023, adopted by unanimous trustee vote with the consent of the Trust Advisory Committee and the Legal Representative). Claimants paid at less than 45% received supplemental payments; allowed-but-unpaid claims were re-noticed at 45% (update posted February 16, 2023). |
| Prior rates | 40% before January 19, 2023. The trust's Law Firm Resource Guide records a cut to 41% on July 14, 2011 and a further cut to 18% on November 3, 2011; the trust has posted no notice dating the climb from 18% back to 40%. |
| Review cycle | The trustees must reconsider the rate at least every two years (Claims Resolution Procedures Sections 2.2 and 3.2) and may authorize supplemental payments to claimants paid at a lower rate, net of all prior payments (Section 2.2). The rate applied is the rate in effect when the claim is allowed (claim filing instructions). |
| Inflation adjustment | Since January 19, 2023 the baseline ALVs carry a 2% annual inflation adjustment, applied to newly allowed claims and then each January 1 beginning January 1, 2024 (notice dated January 19, 2023). Claims allowed before January 19, 2023 did not get it. The trust has not posted an adjusted value table; its FAQ, claim filing instructions, and Resource Guide still print the base values below. |
| Mesothelioma values | Expedited Review ALV $22,500; Individual Review baseline ALV $45,000; Individual Review maximum generally two times baseline; Extraordinary Claim maximum $180,000 (four times baseline). These are the base values from Exhibit 1 to the Claims Resolution Procedures, before the 2% annual adjustment. |
| Mesothelioma payout at the current rate | Expedited Review: about $10,125 ($22,500 x 45%) at the base value. Individual Review baseline: about $20,250 ($45,000 x 45%). Extraordinary Claim maximum: about $81,000 ($180,000 x 45%). By the notice's formula, four 2% steps (January 2023, 2024, 2025, and 2026) would put the baseline mesothelioma ALV near $48,700 and the Expedited Review value near $24,350, but the trust has published no adjusted figures and its allowance letter controls. |
| Review options | Expedited Review (ERC) pays the ERC value, which is 50% of the baseline, with no pricing factors, and is processed first (Section 3.3(a)). Individual Review (IRC) starts at the baseline and moves up or down on the trust's pricing factors: jurisdiction, exposure rating (non-mesothelioma), percentage of NGC exposure (mesothelioma), living status, age, dependents, medical and burial expenses, economic loss, and smoking history (non-mesothelioma). Non-Malignant III claims are Expedited Review only. A claim can be changed from Expedited to Individual Review while in process. |
| Extraordinary Claims | An Individual Review claimant may ask in writing for Extraordinary Claim treatment, with a brief explaining the basis; the trustees may designate a limited number of claims, weighing dependents, unusually high wage loss, and the other factors in Section 3.2(d). Awards run up to four times the baseline ALV ($180,000 for mesothelioma, about $81,000 at 45%). An Extraordinary Claims Review Panel designated by the trustees decides. |
| Exposure requirement | Exposure to NGC asbestos-containing material (NGC ACM), meaning products the National Gypsum Company sold under its own name or the Gold Bond brand (Section 3.10; Restated Exposure Policies revised October 30, 2014). Mesothelioma needs exposure on a regular basis to NGC ACM, which can be less than six months. Every other disease needs at least five years of regular exposure to any asbestos product, including at least six months of regular exposure to NGC ACM. For non-friable NGC ACM (joint compounds, textures, cement boards, shingles), the exposure must have happened during installation or during removal, rip-out, or other disturbance before 1982. For friable NGC ACM (sprayed and troweled acoustical plasters and fireproofing), exposure counts any time from installation until January 1, 1982. Installation is proved by an installer affidavit, by records, or by a building on the trust's Public Site List. |
| Filing deadline | Malignant disease claims: for a diagnosis or death on or after June 16, 1997, three years after the date of death; for a diagnosis and death before June 16, 1997, the statute of limitations of the Applicable Jurisdiction (Section 2.1(c)). Non-malignant claims diagnosed on or after June 16, 2000: three years after the later of March 31, 2005 or the diagnosis date. Deadlines are tolled while a claim is pending in the tort system against another defendant and while a claim is pending with the trust (Section 2.1(e)). |
| Fees and deadlines after filing | No filing fee is posted. An incomplete submission has 365 days to be completed or it is rejected. A deficiency letter carries a 180-day cure period (one 60-day extension on a first deficiency letter, none on a second); a Notice of Determination carries a 180-day period with one 90-day extension on written request before the period runs. A claim may be withdrawn once, before a determination issues, without affecting its statute of limitations status, and reactivated later. |
| Medical rule | Since March 1, 2023, a diagnosis means a comprehensive medical report with a physical examination, medical history, and work history; a B-read alone is not enough for a living claimant (March 2023 notice). The trustees rescinded a planned attorney medical-certificate requirement after the TAC objected. |
| Claims processor | Verus Claims Services, LLC, 3967 Princeton Pike, Princeton, New Jersey 08540 (the trust's contact page; the trust's older documents name Trust Services, Inc. of Greenville, Texas). |
| Trust created | Under the Third Amended Plan of Reorganization of Asbestos Claims Management Corporation (ACMC, formerly National Gypsum Company) dated December 12, 2002, as modified April 21, 2003, confirmed by the United States District Court for the Northern District of Texas, Dallas Division. ACMC's petition date was August 19, 2002. The trust has been receiving and paying claims since 2004 (Restated Exposure Policies). The current procedures are the Eighth Amended Claims Resolution Procedures, effective November 13, 2013. |
| Last checked | October 18, 2026, against ngcbitrust.org (home, About Us, Resources, Notices, FAQ, and Contact pages), the Eighth Amended Claims Resolution Procedures, the Instructions for Filing a Claim (November 18, 2013), the Law Firm Resource Guide, the Restated Exposure Policies (revised October 30, 2014) and Exhibit 1 Minimum Exposure Requirements (November 2013), the NGC ACM Product List (public version, revised January 2017), the Public Site List (revised November 2012), and the notices dated January 19, 2023 (45% and inflation adjustment), February 16, 2023 (update), March 2023 (diagnosis clarification), and April 22, 2020 (release changes). |
SCHEDULE OF DISEASES
The trust uses six disease categories and three value columns: the Expedited Review value (50% of baseline), the Individual Review baseline (100%), and the Extraordinary Claim maximum (400%). The Individual Review maximum for an ordinary claim is generally two times the baseline. The values below are the base figures from Exhibit 1 to the Claims Resolution Procedures, which the trust's FAQ, filing instructions, and Resource Guide all print; since January 19, 2023 the trust adds a 2% annual inflation adjustment at allowance that it has not published as a table.
| Disease | Expedited Review ALV | Payout at 45% | IR Baseline ALV | Payout at 45% | Extraordinary Max |
|---|---|---|---|---|---|
| Mesothelioma | $22,500 | About $10,125 | $45,000 | About $20,250 | $180,000 |
| Lung Cancer | $3,750 | About $1,688 | $7,500 | About $3,375 | $30,000 |
| Other Cancer | $1,600 | About $720 | $3,200 | About $1,440 | $12,800 |
| Non-Malignant I | $1,000 | About $450 | $2,000 | About $900 | $8,000 |
| Non-Malignant II | $500 | About $225 | $1,000 | About $450 | $4,000 |
| Non-Malignant III | $250 | About $113 | Expedited Review only | None | None |
The payout columns are the base value times 45%, rounded, before the inflation adjustment. Because the Expedited Review value is half the baseline and Individual Review for mesothelioma is scored on the percentage of NGC exposure, living status, age, dependents, and economic loss, a mesothelioma claimant with a strong Gold Bond exposure history usually does better in Individual Review, and living mesothelioma claimants are already treated as exigent for processing priority. The trust pays no interest and no sequencing adjustment (Section 2.6).
FILING REQUIREMENTS
The trust checks three things on every claim: the disease, the exposure, and the timing. Its exposure rules are the most detailed of any trust we file against, and they turn on whether the product was friable.
The claimant must show exposure to NGC ACM, the asbestos products National Gypsum sold under its own name or the Gold Bond brand (Claims Resolution Procedures Section 3.10). The Restated Exposure Policies (revised October 30, 2014) break the proof into two steps: establishing that NGC ACM was installed at a specific jobsite, and describing the injured person's exposure to it in an NGC-specific affidavit, deposition, or other sworn testimony. Installation is proved by an installer's affidavit (the injured person, a co-worker, or another witness who can say how they knew the product was National Gypsum), by invoices or construction records, or by a building on the trust's Public Site List, which the trust calls a Common Exposure Location. The trust's product list marks each product friable or non-friable with its years of sale. For non-friable products, such as joint compounds, textures, asbestos-cement boards, and shingles, the exposure must have happened during installation or during removal, rip-out, or other disturbance before 1982, and only for the days, weeks, or months the material was giving off fiber. For friable products, such as Sprayolite, Perfo-Lyte, Gold Bond Acoustical Plaster, Macoustic, and Fire-Shield Plaster, exposure counts any time from installation until January 1, 1982. Mesothelioma needs regular exposure to NGC ACM, which may be less than six months. Every other disease needs at least five years of regular exposure to any asbestos product, including at least six months of regular exposure to NGC ACM. The trust publishes eight form affidavits (installer, exposure during installation, and post-installation friable and non-friable, each in mesothelioma and non-mesothelioma versions) and Exhibit 1 Minimum Exposure Requirements spelling out what each must say.
Since March 1, 2023, a diagnosis or medical report means a comprehensive medical report that identifies an asbestos disease and includes at least a physical examination, a medical history, and a work history. A B-read report alone is not enough for a living claimant, though it can support a non-malignant claim for a deceased claimant when no comprehensive report exists (March 2023 notice). The trust's Medical Disease Criteria and Medical Disease Chart set the pulmonary function and radiographic requirements for the non-malignant categories, and the trust keeps a list of physicians whose reports it does not accept. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.
For a malignant disease diagnosed or resulting in death on or after June 16, 1997, the deadline is three years after the date of death (Section 2.1(c)). For a diagnosis and death before June 16, 1997, the statute of limitations of the Applicable Jurisdiction applies, which is the state where the claimant sued ACMC or another defendant, or, with no lawsuit, the state of exposure or residence as of August 19, 2002. Non-malignant claims diagnosed on or after June 16, 2000 are due three years after the later of March 31, 2005 or the diagnosis date. The deadlines are tolled while a claim is pending in the tort system against another defendant and while a claim is pending with the trust, until 180 days after the trust's determination or 90 days after the claimant rejects a non-binding arbitration award (Section 2.1(e)). A living mesothelioma claimant has no death-date clock running yet, but the trust's 365-day incomplete-submission rule and 180-day cure periods do run once the claim is filed.
Expedited Review pays the ERC value times 45%, about $10,125 for mesothelioma at the base value, with no pricing factors and faster processing. Individual Review starts at the $45,000 baseline (about $20,250) and moves up or down on the trust's factors, up to generally two times the baseline. An Individual Review claimant may ask in writing for Extraordinary Claim treatment with a brief setting out the basis; the Extraordinary Claims Review Panel decides, and the award can reach four times the baseline, $180,000, about $81,000 at 45%. A claimant who rejects the trust's offer can go to mediation or arbitration under the trust's ADR Procedures, and the deadline tolling runs 90 days past a rejected non-binding award. Claims in process can be changed from Expedited to Individual Review, and paid claims can be upgraded when a more serious disease is diagnosed later, including from a non-malignant disease to a cancer.
RATE HISTORY
The trust has paid claims since 2004 and has moved its rate in both directions. Its Law Firm Resource Guide records that the payment percentage was reduced to 41% on July 14, 2011 and cut again to 18% on November 3, 2011. The rate later returned to 40%, the figure the trust's FAQ page and filing documents still show; the trust has posted no notice dating that recovery, so this page does not guess at it.
By notice dated January 19, 2023, the trustees, with the consent of the Trust Advisory Committee and the Legal Representative, voted unanimously to raise the Payment Sum Percentage from 40% to 45%, effective that day, to pay supplemental payments to everyone paid at less than 45%, and to adopt a 2% annual inflation adjustment to the baseline Allowed Liquidated Values for claims allowed on or after January 19, 2023, repeating each January 1 from 2024. Allowed-but-unpaid claims were re-noticed at 45% by February 16, 2023. The Claims Resolution Procedures require the trustees to reconsider the rate at least every two years, so the rate has been due for review since early 2025; nothing newer is posted.
PRODUCTS AND WORK SITES
The trust's NGC ACM Product List (public version, revised January 2017) names 149 products and product types by code, with the years each was sold and whether it is friable. The friable group is the acoustical plaster and fireproofing line: Spray-On Acoustical Plaster (1955 to 1956), Sprayolite (1956 to 1973), Thermacoustic (1949 to 1961), Gold Bond Sprayed Limpet Asbestos (1945 to 1949), Perfo-Lyte (1955 to 1972), Gold Bond Acoustical Plaster (1949 to 1968), the Macoustic plasters (1933 to 1949), Rockwall Acoustical Plaster (1936 to 1940), and Fire-Shield Plaster (1958 to 1970). The non-friable group covers asbestos-cement boards, panels, and corrugated sheets (Asbestone, Flexbestos, Permaboard, Thermotec, Woodrock), asbestos-cement roofing and siding shingles (Chromashake, Chromatex, Classic-Shake, Deeptex), and the joint treatment and texture products drywall finishers used every day: All-Purpose Joint Compound (1966 to 1973), Joint Compound and No. 1 Ames Cement (1949 to 1973), Ready Mixed Joint Compound (1953 to 1976), Topping Compound (1958 to 1976), Sta-Smooth, Triple T, Tri-Treatment, Velvet Joint and Topping Compounds, Vinyl Topping Compound (1964 to 1976), Wesco Joint Cement, and the Craftex, E-Z Tex, Painters Texture, and E-Z Spray textures. Our Gold Bond product page covers the brand's history. A claim is proved one of two ways.
The Public Site List leans heavily toward schools, churches, and public buildings sprayed with Sprayolite or troweled with Perfo-Lyte and Gold Bond Acoustical Plaster. Its 67 Illinois entries include the Gilson Brown, Godfrey, Humboldt, Mark Twain, and North Middle schools in Alton, Morton West High School in Berwyn, South Junior High in Arlington Heights, the arena in Carbondale, the Life Science Annex in Charleston, and more than two dozen Chicago public schools (Abbott, Banneker, Einstein, Garvy, Gresham, Hale, Hinton, Johnson, Lathrop, Sauganash, Simpson, Smyth, and others). Its 33 Missouri entries are mostly St. Louis parochial schools and churches (Duchesne High School, Immacolata, Immaculate Conception, Most Precious Blood, Our Lady of Good Counsel, St. Anthony, St. Clement, St. Dominic Savio, St. George, St. Joan of Arc, St. Thomas Aquinas-Mercy, St. Vincent, St. William, and others) plus the Alameda Plaza and Raphael hotels in Kansas City and National Gypsum's own St. Louis plant, where raw asbestos fiber was used from 1953 to 1971. The list also names National Gypsum manufacturing plants in Medicine Lodge, Kansas, and across the country, and the Merabank Building in Phoenix. Those are the places where plasterers, construction trades, HVAC workers running duct above sprayed ceilings, school custodians and maintenance workers, and factory workers at the gypsum plants breathed the dust. The same drywall and plaster work usually supports claims against USG, W.R. Grace, Bondex, and Celotex, and our page on products that contained asbestos explains how these building materials released fiber.
QUESTIONS
As of October 18, 2026, the NGC Bodily Injury Trust pays 45% of a claim's Allowed Liquidated Value. The trustees raised the rate from 40% to 45% effective January 19, 2023, by notice dated the same day, with supplemental payments to claimants paid at lower rates. The trust's FAQ page still says 40%, but the January 19, 2023 notice controls.
The base values are $22,500 for Expedited Review and $45,000 for the Individual Review baseline, so a mesothelioma claim pays about $10,125 through Expedited Review or about $20,250 at the Individual Review baseline at 45%, before the 2% annual inflation adjustment the trust has applied since January 19, 2023. An Extraordinary Claim can reach $180,000, about $81,000 at 45%.
For a mesothelioma or other cancer diagnosed on or after June 16, 1997, the deadline is three years after the date of death, and the clock is tolled while a lawsuit against another defendant or a claim with the trust is pending. A living claimant's deadline has not started, but the exposure proof gets harder every year, so the claim should be filed soon after diagnosis. Non-malignant claims diagnosed on or after June 16, 2000 are due three years after the later of March 31, 2005 or the diagnosis.
WHY THRONEBERRY LAW GROUP
National Gypsum is a small-value trust with an exacting exposure rulebook: eight different affidavit forms, a friable-or-not test that decides whether exposure after installation counts, and a product list with sale years that the affidavit has to match. A claim that names the wrong product or the wrong years draws a deficiency letter, and a firm that will not spend the time files it as an Expedited Review claim at half value or skips it. We match the client's work history against the 149-product list and the Public Site List, pick the affidavit form that fits, and elect Individual Review for mesothelioma clients whose NGC exposure share scores well. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
We work on contingency, so you pay nothing unless we recover money for you. We serve clients nationwide, we can help Spanish-speaking families, and we travel to you, including to your home or hospital.
