Asbestos is a naturally occurring, fibrous mineral which was widely used for insulation and fire resistant materials in construction, ship building, and automobile parts. It is a material used due its strength and ability to insulate and resist heat, electricity, and chemical attack. The U.S. Environmental Protection Agency banned some uses of asbestos back in 1973¹. However, it remains inside millions of buildings and homes today. It still continues to be used in some products imported from outside the country, such as clutches for vehicles and brake pads.

A group of plaintiffs recently filed a federal lawsuit against an asbestos litigation trust set up by their former employer to recover millions in unpaid claims they allege the administrators are squandering. In addition to this suit, the asbestos litigation trust set up to disperse compensation to victims also faces hundreds of other claims over allegations that workers at a Texas-based plant were exposed to asbestos for decades. The case began in 2000 when the defendants, Tyler Pipe and Swan Transportation, lost a pair of multimillion dollar asbestos exposure lawsuits which ultimately bankrupted the companies.

Missouri jurors in two talcum powder ovarian cancer lawsuits recently handed down a pair of monumental awards for plaintiffs totaling $137 million between the two. This could spell bad news for the defendant, Johnson & Johnson, as there are an additional 1,200 more talcum powder lawsuits working their way through the courts. While attorneys for the plaintiffs successfully demonstrated to the jurors the J&J talcum powder products were more than likely responsible for their plaintiff’s ovarian cancer, questions still remain as to what exactly the relationship is between use of talc and developing cancer.

Image via Wikipedia The Italian biotechnology company, MolMed S.p.A, announced the expansion of its anticancer drug NGR-hTNF for the treatment of malignant pleural mesothelioma into the United States, Canada and the European Union. Mesothelioma is a rare cancer linked to asbestos exposure that attacks the lining of the organs – lung, heart and abdomen. The most common is malignant pleural mesothelioma or cancer of the lining of the lungs. Mesothelioma has a long latency period and symptoms are non-specific, so in most cases diagnosis is difficult before the advanced stages of the disease.

A New Jersey Superior Court judge recently denied a motion by the defendant in a talcum powder asbestos cancer lawsuit which sought to set aide a multimillion dollar verdict handed down by a state jury to a group of plaintiffs who claimed they developed serious forms of cancer due to asbestos fibers in talc-based products produced by the defendant. That lawsuit claimed pharmaceutical and cosmetics giant Johnson & Johnson knowingly sold asbestos-contaminated talcum powder products for years, without any warnings to consumers about the known risks of asbestos exposure.
