TRUST PAYMENT REFERENCE
A payment reference for the ACandS Asbestos Settlement Trust, which pays claims for asbestos products of ACandS, Inc., formerly Armstrong Contracting and Supply, Inc. Every figure below was checked against the trust's own website, notices, Approved Site List, and Trust Distribution Procedures on October 18, 2026.
CURRENT TRUST STATUS
The ACandS asbestos trust is paying claims at a proposed 2.89% of scheduled value. The trustee proposed that rate by notice dated May 11, 2026, down from the 3.2% adopted on September 29, 2025, and began paying new claims at 2.89% that day while the Trust Advisory Committee and the Future Claimants' Representative consider it. A mesothelioma claim carries a $150,000 scheduled value, so an Expedited Review mesothelioma claim pays about $4,335 at the proposed rate, or about $4,800 if the adopted 3.2% stands. The rate has fallen at every reconsideration since 2020. Every claim needs ACandS exposure before December 31, 1982.
Throneberry Law Group files ACandS claims for insulators, pipefitters, boiler workers, and other trades and their families across the country. This page is part of our asbestos trust funds guide, which covers every trust we file against. ACandS pays a few cents on the dollar, but its Approved Site List of 1,495 job sites reaches plants, refineries, power stations, and schools in nearly every state, and the same work history supports claims against the larger insulation trusts.
PAYMENT REFERENCE
The table below is the short answer. The sections that follow explain each line.
| Current payment percentage | 2.89% proposed and paid on new claims since May 11, 2026 (Notice Regarding Payment Percentage Reduction dated May 11, 2026). The adopted rate is 3.2%, set September 29, 2025. If the TAC and the Future Claimants' Representative settle on a rate above 2.89%, claimants paid at 2.89% receive a supplemental payment for the difference (TDP Section 4.3). |
|---|---|
| Who keeps the 3.2% rate | Claimants who received a release before May 11, 2026 and sent it back signed before that date (or within 30 days of receiving it, if it arrived less than 30 days before). Deceased or incompetent claimants whose offers are awaiting court or probate approval are paid at the rate in effect when the offer was first made. |
| Prior rates | 3.2% adopted September 29, 2025 (proposed September 30, 2024). 4.0% effective October 30, 2023 (proposed June 16, 2023). 4.9% effective January 1, 2021 (3.8% had been proposed June 4, 2020). 7.2% before that. The TDP set the initial rate at 5.78%. |
| Review cycle | At least once every three years (TDP Section 4.2). The trustee gave notice of a reconsideration on April 2, 2026 and proposed the new rate on May 11, 2026. |
| Mesothelioma scheduled value | $150,000 (Disease Level VII, TDP Section 5.3(b)(3)). Individual Review average $180,200, maximum $550,000. |
| Mesothelioma payout at the current rate | About $4,335 under Expedited Review ($150,000 x 2.89%), or about $4,800 at the adopted 3.2%. Individual Review pays the percentage on the value the trust sets, up to $550,000 before the percentage, or about $15,895 after it at 2.89%. |
| Review options | Expedited Review for Levels I, II, III, IV, VI, and VII. Individual Review only for Lung Cancer 2 (Level V), Extraordinary Claims, and claims that want a higher value than the schedule. |
| Exposure requirement | Meaningful and credible exposure before December 31, 1982 to asbestos or asbestos products for which ACandS has legal responsibility (TDP Section 5.7(b)(3)). Mesothelioma and Lung Cancer 2 need ACandS exposure only. Levels II, III, IV, and VI need six months of ACandS exposure plus Significant Occupational Exposure (five cumulative years in an asbestos trade, at least two before December 31, 1982). Level I needs six months of ACandS exposure plus five years of occupational asbestos exposure. The trust's Approved Site List (1,495 sites as of December 3, 2013) gives the dates ACandS is known to have worked at each site, and the trust's claim checklist treats exposure claims from high-temperature trades such as boiler workers, pipefitters, and insulators as credible. |
| Secondary exposure | A family member or other person exposed through an occupationally exposed worker can file. The worker must meet the trust's exposure rules, the secondary exposure must fall in the same period, and for diseases other than mesothelioma the secondary exposure must have lasted at least five times the duration the worker would have needed (TDP Section 5.5, as amended December 18, 2025). |
| Filing deadline | For anyone diagnosed after the September 16, 2002 petition date, within three years after diagnosis or by November 23, 2012, whichever is later, regardless of any state statute of limitations; a longer state limitations period applies if the claimant's state gives one (TDP Section 5.1(a)(2); Important Notice Concerning Filing Deadlines dated May 2, 2012). Claims diagnosed before the petition date, and pending or tolled against ACandS on that date, had to be filed by November 23, 2012. |
| Deemed withdrawn policy | A claim is treated as withdrawn if the claimant does not accept, reject, or start arbitration within 180 days of an offer, or does not answer a deficiency notice within 180 days (effective March 12, 2012). A withdrawn or deferred claim can be refiled with its limitations status intact but goes to the back of the queue; deferral for up to three years keeps the claimant's place (TDP Section 6.3). |
| Sequencing adjustment | A claim that waits a year or more for payment earns an interest-style addition of 1% a year (6% a year for time before 2013), capped at five years and excluding time spent in deferral, withdrawal, deficiency, or offer-issued status (TDP Section 7.5). |
| Extraordinary Claims | Up to five times the scheduled value for the level, multiplied by the payment percentage (TDP Section 5.4(a)). For mesothelioma that is $750,000 before the percentage, or about $21,675 after it at 2.89%. For claims where at least 75% of the exposure was to products ACandS is responsible for and there is little likelihood of a substantial recovery elsewhere. Individual Review only, and paid ahead of other claims in the queue. |
| Fees | None. The TDP leaves a filing fee to the trustee's discretion (Section 6.4), and the trust's Filing Instructions and Claim Filing Checklist set none. |
| Claims processor | Verus Claims Services, Princeton, New Jersey. Electronic filing through the Verus portal is the trust's recommended route. |
| Claims accepted since | May 26, 2009. The Initial Claim Filing Date was November 23, 2009; claims filed between those dates were treated as filed on November 23, 2009. |
| Trust created | 2008, under the Chapter 11 plan of ACandS, Inc. ACandS filed for Chapter 11 on September 16, 2002. The current TDP is the Amended and Restated TDP dated January 1, 2021, with a Ninth Amendment dated December 18, 2025 that rewrote Section 5.5 on secondary exposure claims. |
| Last checked | October 18, 2026, against acandsasbestostrust.com, the Amended and Restated TDP (January 1, 2021, with the December 18, 2025 amendment), the Approved Site List as of December 3, 2013, the Filing Instructions and Claim Filing Checklist, and the trust's notices dated March 31, 2011 (exposure and medical evidence), March 12, 2012 (response deadlines), May 2, 2012 (filing deadlines), June 4, 2020, January 2021, June 16, 2023, November 3, 2023, September 30, 2024, September 29, 2025, April 2, 2026, and May 11, 2026 (payment percentage). |
SCHEDULE OF DISEASES
The trust sorts asbestos diseases into seven levels. Six carry a fixed scheduled value for Expedited Review. Lung Cancer 2 has no scheduled value and goes through Individual Review only. The average and maximum values come from TDP Section 5.3(b)(3) and apply to Individual Review. The payout column uses the proposed 2.89% rate the trust has paid since May 11, 2026.
| Level | Disease | Scheduled Value | IR Average | IR Maximum | ER Payout at 2.89% |
|---|---|---|---|---|---|
| VII | Mesothelioma | $150,000 | $180,200 | $550,000 | About $4,335 |
| VI | Lung Cancer 1 | $50,000 | $50,500 | $125,000 | About $1,445 |
| V | Lung Cancer 2 | None | $10,120 | $50,000 | Individual Review |
| IV | Other Cancer | $14,000 | $14,100 | $50,000 | About $405 |
| III | Severe Asbestosis | $40,000 | $40,100 | $100,000 | About $1,156 |
| II | Asbestosis / Pleural Disease | $7,500 | Not set | Not set | About $217 |
| I | Asbestosis / Pleural Disease | $3,000 | Not set | Not set | About $87 |
The Expedited Review payout is the scheduled value times 2.89%, rounded. At the adopted 3.2% the mesothelioma figure is about $4,800. The TDP's own text gives two averages for Lung Cancer 2: the value table says $10,120 and the level description says $12,000; the table is used here. Mesothelioma's scheduled value is among the higher ones for an insulation contractor trust; the rate is what makes the payout small.
FILING REQUIREMENTS
The trust checks three things on every claim: the disease, the exposure, and the timing. There is no filing fee.
The claimant must show meaningful and credible exposure before December 31, 1982 to asbestos or asbestos products for which ACandS has legal responsibility (TDP Section 5.7(b)(3)). The trust accepts an affidavit or sworn statement from the worker, from a co-worker, or from a family member of a deceased worker, as well as invoices, employment, construction, or similar records, interrogatory answers, sworn work histories, and depositions. The Filing Instructions add that a fully completed claim form signed under penalty of perjury is accepted as evidence of exposure, and the trust's March 31, 2011 notice says a claimant whose ACandS exposure is enough on its own need not document other companies' products. The trust's Approved Site List, 1,495 job sites as of December 3, 2013, gives each site's start and end dates; the claim checklist asks for the site code, a matching site name and location, and a work period that overlaps the listed dates. The checklist also treats exposure claims from workers in high-temperature settings, such as boiler workers, pipefitters, and insulators, as credible, while other trades must describe hands-on use of, or close work near, ACandS products. Mesothelioma and Lung Cancer 2 need ACandS exposure only. Levels II, III, IV, and VI also need six months of ACandS exposure and Significant Occupational Exposure, which means five cumulative years in a trade that handled, fabricated, or worked with asbestos products, or worked regularly alongside those who did, with at least two of those years before December 31, 1982 (TDP Section 5.7(b)(2)). Level I needs six months of ACandS exposure and five years of occupational asbestos exposure.
Every diagnosis must come with either a physician's statement that at least ten years passed between first asbestos exposure and diagnosis, or an exposure history that shows a ten-year latency (TDP Section 5.7(a)(1)). A cancer diagnosis, mesothelioma included, must rest on a physical examination by the diagnosing physician or on a diagnosis by a board-certified pathologist or a pathology report from a hospital accredited by the Joint Commission (Section 5.7(a)(1)(B)); the trust's checklist asks for an unequivocal pathological diagnosis of malignant mesothelioma. Non-malignant levels require a physical examination for living claimants and the findings the TDP lists for the level, such as a B-reading of 1/0 or higher for Levels I and II, 2/1 or higher or pathology for Severe Asbestosis, and pulmonary function tests that meet American Thoracic Society standards. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.
For anyone diagnosed after September 16, 2002, the TDP's own deadline is three years after diagnosis or November 23, 2012, whichever is later, and it applies regardless of any state statute of limitations (TDP Section 5.1(a)(2)); if the claimant's state allows longer, the longer period applies. For a diagnosis today, that means three years from the diagnosis date. Claims diagnosed before the petition date, and pending or tolled against ACandS on that date, had to be filed by November 23, 2012 (notice dated May 2, 2012). Once a claim is in, an offer or deficiency notice left unanswered for 180 days is treated as a withdrawal (effective March 12, 2012). A withdrawn claim can be refiled with its limitations status intact but goes to the back of the line, and a claimant who needs time can instead defer for up to three years and keep their place. We file soon after diagnosis and answer every notice well inside the window.
Expedited Review pays the scheduled value times the payment percentage once the claim meets the level's medical and exposure criteria. For mesothelioma that is about $4,335 at 2.89%. Individual Review looks at the whole case and can set a value up to $550,000 for mesothelioma before the percentage, or about $15,895 after it. Lung Cancer 2 claims and Extraordinary Claims must use Individual Review. An Extraordinary Claim, where at least 75% of the worker's exposure was to products ACandS is responsible for and there is little chance of a substantial recovery elsewhere, can be valued at up to five times the scheduled value (TDP Section 5.4(a)), which for mesothelioma is $750,000 before the percentage and about $21,675 after it. At under 3%, the extra time Individual Review takes is rarely worth it, so most ACandS claims go through Expedited Review while the effort goes to the larger trusts in the same work history.
RATE HISTORY
The TDP set the initial payment percentage at 5.78%. By 2020 the trust was paying 7.2%; the trust has posted no notice dating that step. On June 4, 2020 the trustee proposed a cut to 3.8% and began paying new claims at that rate. The result, by notice dated January 2021, was 4.9% effective January 1, 2021, well above the proposal, with supplemental payments to everyone paid at 3.8%. On June 16, 2023 the trustee proposed 4% and began paying at that rate; a notice dated November 3, 2023 adopted 4.0% effective October 30, 2023. On September 30, 2024 the trustee proposed 3.2%; a notice dated September 29, 2025 adopted it.
On April 2, 2026 the trustee gave notice that the rate would be re-determined again, and on May 11, 2026 proposed 2.89%, paying new claims at that rate from that day while the Trust Advisory Committee and the Future Claimants' Representative consider it (TDP Sections 4.2 and 4.3). If a higher rate is adopted, claimants paid at 2.89% receive a supplemental payment for the difference. Four reconsiderations in six years have each lowered the rate, and the TDP requires another within three years.
PRODUCTS AND WORK SITES
The trust's documents describe ACandS, Inc. as the debtor, formerly Armstrong Contracting and Supply, Inc., and its TDP defines covered exposure by legal responsibility rather than by product: any asbestos or asbestos-containing product for which ACandS is responsible, before December 31, 1982. The trust publishes no product list. Its Approved Site List is the working tool, and the claim checklist's rule that exposure claims from high-temperature trades are credible on their face tells you where ACandS worked: around boilers, steam lines, and process equipment. A claim is usually proved one of two ways.
The list includes 32 Illinois sites, among them Shell Oil in Wood River, Alton Box Board, the W.G. Krummrich plant in Sauget, Charles Pfizer in East St. Louis, Hiram Walker and Caterpillar in the Peoria area, Commonwealth Edison's Powerton Station in Pekin, Amoco Chemical in Joliet, Archer Daniels Midland in Decatur, and several Chicago buildings. It includes 18 Missouri sites, among them the Chemagro plants and J.F. Pritchard in Kansas City, Anheuser-Busch and the Chevrolet assembly plant in St. Louis, the New Madrid steam plant, and the Sibley power units, plus Farmland Industries in Kansas City, Kansas. Florida has 59 listed sites, including Monsanto in Gonzalez and the Disney World Polynesian resort. Those sites are the power plants, refineries, chemical plants, and factories where insulators, construction trades, power plant workers, and refinery workers breathed the dust. The same work history usually supports claims against the other insulation trusts, such as Armstrong World Industries, Owens Corning and Fibreboard, Pittsburgh Corning, and Johns-Manville, and the proof built for those trusts carries the ACandS claim.
QUESTIONS
As of October 18, 2026, the ACandS Asbestos Settlement Trust pays new claims at a proposed 2.89% of scheduled value, under a notice dated May 11, 2026. The adopted rate is 3.2%, set September 29, 2025. The rate was 4.0% from October 30, 2023, 4.9% from January 1, 2021, and 7.2% before that.
The mesothelioma scheduled value is $150,000. At the proposed 2.89% rate, an Expedited Review claim pays about $4,335; at the adopted 3.2% it is about $4,800. Individual Review can set a value up to $550,000 before the percentage, which is about $15,895 at 2.89%.
Usually not. For anyone diagnosed after September 16, 2002, the trust's own deadline is three years after diagnosis, and the TDP applies it regardless of state statutes of limitations. The exposure must have happened before December 31, 1982, and there is no filing fee, so the safest step is to file soon after diagnosis.
WHY THRONEBERRY LAW GROUP
An ACandS claim is worth about $4,335 for mesothelioma, and a firm that files it alone is wasting your time. We file it because the same insulation, boiler, and steam-line work that proves ACandS exposure proves Armstrong, Owens Corning, Pittsburgh Corning, and Johns-Manville exposure too, and together those claims add up. We build the site and trade proof once, run it against every insulation trust's list, and file them as a set. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
