TRUST PAYMENT REFERENCE
A payment reference for the Yarway Asbestos Personal Injury Trust, which pays claims for asbestos exposure to the Yarway Product Lines, the asbestos-containing products, equipment, and parts made, sold, supplied, installed, serviced, or distributed by Yarway Corporation and Gimpel Corporation. Every figure below was checked against the trust's own Trust Distribution Procedures, notices, filing instructions, approved site list, and presumptive occupation list on October 18, 2026.
CURRENT TRUST STATUS
The Yarway asbestos trust pays 27.5% of a claim's liquidated value. The trustee raised the rate from 25% to 27.5% effective May 1, 2024, with the consent of the Trust Advisory Committee and the Future Claimants' Representative, and paid supplemental payments to claimants paid at 25%. A mesothelioma claim carries a $55,000 scheduled value, so an Expedited Review claim pays about $15,125. Individual Review averages $80,000 (about $22,000 at 27.5%) with a $150,000 maximum. Two things about the trust's current status matter more than the rate. On December 10, 2025 the trustee announced a reconsideration of the payment percentage and has not posted a new rate. And on August 18, 2026 the trust announced that it had reached 85% of its 2026 Maximum Available Payment for Category A (malignancy and severe asbestosis) claims, that most August payments would be made in October, and that after the October run no further Category A payments would be made until January 2027 or a reset of the payment percentage. Claims carried over keep their payment percentage and go to the head of the payment queue.
Throneberry Law Group files Yarway claims for Navy veterans and merchant mariners, power plant and powerhouse mechanics, steamfitters, pipefitters, boiler workers, and the other trades on the trust's presumptive occupation list, and their families, across the country. This page is part of our asbestos trust funds guide, which covers every trust we file against. Our Yarway Corporation company page covers the company's history.
PAYMENT REFERENCE
The table below is the short answer. The sections that follow explain each line.
| Current payment percentage | 27.5% of the liquidated value for all seven disease levels. |
|---|---|
| In effect since | May 1, 2024 (Payment Percentage Increase Notice dated May 7, 2024, with the consent of the TAC and the FCR). Claimants paid at the prior 25% rate received supplemental payments where the TDP permits. |
| Reconsideration pending | On December 10, 2025 the trustee gave notice under TDP Section 4.2 that the payment percentage is under reconsideration and would be re-determined no sooner than 30 days after that date. A claimant who received a release before any proposed change is announced keeps the current rate by returning it by the later of the announcement date or 30 days after receipt. If a higher rate is adopted, claimants paid at the lower rate receive supplemental payments. As of October 18, 2026 the trust has posted no new rate. |
| Prior rates | 25% Initial Payment Percentage, set by the trustee with the consent of the TAC and the FCR when the trust opened (Filing Instructions); 27.5% from May 1, 2024. The trust has posted no other rate change. |
| Claims payment ratio and annual cap | Enforced. The TDP sets a Maximum Annual Payment and splits the Maximum Available Payment 90% to Category A claims (Disease Levels III through VII) and 10% to Category B claims (Levels I and II), and limits payments in the first nine months of a year to 85% of the annual maximum (Sections 2.4 and 2.5). The trust's notice dated August 18, 2026 states that Category A had reached 85% of the 2026 amount before the August payment run, that most August payments would be made in October (reaching 90%), and that no further Category A payments would be made until the earlier of January 2027 or a resetting of the payment percentage with a new Maximum Available Payment. Carried-over claims go to the head of the FIFO Payment Queue and keep the payment percentage they would otherwise receive. |
| Inflation adjustment | None. The TDP has no annual inflation adjustment; the values below are the TDP values. |
| Mesothelioma scheduled value | $55,000 scheduled; $80,000 Individual Review average; $150,000 Individual Review maximum (Section 5.3(b)(3)). |
| Mesothelioma payout at the current rate | Expedited Review: about $15,125 ($55,000 x 27.5%). Individual Review awards are paid at 27.5% of the liquidated value, up to the maximum (about $41,250 at the $150,000 cap). |
| Review options | Expedited Review pays the scheduled value times 27.5% once the claim meets the medical and exposure criteria (Section 5.3(a)). Individual Review values the claim on the law of the claimant's jurisdiction and the trust's factors, up to the maximum (Section 5.3(b)). Lung Cancer 2 (Level V), Foreign Claims, Extraordinary Claims, and secondary (take-home) exposure claims must go through Individual Review (Sections 5.4 and 5.5). |
| Extraordinary Claims | Disease Levels I through VII. A claimant whose exposure occurred predominantly while working in a Yarway or Gimpel manufacturing facility while it made asbestos products, or was at least 75% the result of Yarway Exposure, with little likelihood of a substantial recovery elsewhere, can be awarded up to five times the scheduled value (five times the average value for Level V), times 27.5% (Section 5.4(a)). For mesothelioma that is up to $275,000, about $75,625 at 27.5%. The trustee may ask for evidence of the claimant's other recoveries. |
| Exposure requirement | Yarway Exposure: meaningful and credible exposure before December 31, 1982 to the Yarway Product Lines, meaning asbestos-containing products, equipment, components, parts, or materials engineered, designed, manufactured, sold, supplied, installed, maintained, serviced, repaired, removed, replaced, or distributed by Yarway Corporation or Gimpel Corporation (Section 5.7(b)(3)). Mesothelioma needs Yarway Exposure only. Lung Cancer 1, Other Cancer, Severe Asbestosis, and Level II need six months of Yarway Exposure before December 31, 1982 plus Significant Occupational Exposure (five cumulative years in an asbestos trade, at least two before December 31, 1982). Level I needs six months of Yarway Exposure plus five years of occupational asbestos exposure. Proof may be an affidavit of the claimant, a co-worker, or (for a deceased claimant) a family member, invoices, employment or construction records, or other credible evidence. Since January 1, 2022 the trust accepts exposure affidavits signed under penalty of perjury through DocuSign or a similar program with an audit certificate, as well as state-law affidavits and 28 U.S.C. 1746 declarations. |
| Approved site list and presumptive occupations | The trust publishes an Approved Jobsite List (revised November 19, 2018) of 477 sites where it has confirmed that products for which it is responsible were present: 409 ships and 68 land sites, including five Illinois sites (Dresden Nuclear Power Station in Morris, Quad Cities Station in Cordova, Commonwealth Edison's Crawford Station in Chicago and Station 16 in Waukegan, and the University of Chicago power plant) and Fort Leonard Wood in Missouri. The trust requires documentation that the claimant worked at the approved site, and the occupational exposure criteria still apply (notices dated June 6 and September 12, 2018). The trust's Presumptive Occupations list accepts boiler workers, coppersmiths, machinists, millwrights, powerhouse mechanics, sprinkler fitters, steamfitters, maintenance mechanics, pipefitters, plumbers, HVAC workers, and shipyard and shipboard trades (electricians, engine room workers, firemen, sheet metal workers, shipfitters) in the shipyard, industrial, and railroad industries without further detail about how the worker used Yarway products, provided the product identification is acceptable. |
| Filing deadline | Anyone first diagnosed after April 22, 2013 (the Petition Date) may file within three years after diagnosis or by June 21, 2019 (three years after the June 21, 2016 Initial Claims Filing Date stated in the trust's statute of limitations notice; the trust's home page gives the date as June 20, 2016), whichever is later, regardless of any state statute of limitations (Section 5.1(a)(2)). Claims diagnosed before April 22, 2013 were timely only if they were pending, tolled, or still within the statute of limitations on the Petition Date and were filed by June 21, 2019. |
| Fees and withdrawal rules | No filing fee. The TDP leaves a fee to the trustee's discretion (Section 6.4) and the trust's filing instructions and claim form require none. Since January 13, 2016 a claimant has 180 days to cure a deficiency and 180 days to accept, reject, or arbitrate an offer; silence deems the claim deferred for up to three years, after which it is deemed withdrawn. The statute of limitations is tolled for a later resubmission if it was still running at the original filing (trust letter dated January 13, 2016). |
| Claims processor | Verus Claims Services, LLC, 3967 Princeton Pike, Princeton, New Jersey 08540, through the Verus electronic filing system (Law Firm Registration Form and Electronic Filing Agreement required). The trust's principal office is c/o Wilmington Trust Company, 1100 N. Market Street, Wilmington, Delaware 19890. The trustee is Hon. Helen Freedman (Ret.), New York. |
| Trust created | Under the Yarway Corporation Chapter 11 Joint Plan of Reorganization, confirmed in 2015. Yarway filed its petition April 22, 2013 (the Petition Date). The trust was created in 2015, began accepting claims December 21, 2015, and set the Initial Claims Filing Date in June 2016. Yarway Product Lines include the products of Yarway Corporation (Pennsylvania), Gimpel Corporation (Delaware, merged into Yarway in 2000), and Gimpel Machine Works, Inc. (Pennsylvania). |
| Last checked | October 18, 2026, against yarwaytrust.com (home, About Us, Resources, Notices, and Contact Us pages), the Yarway Trust Distribution Procedures, the Filing Instructions, the Payment Percentage Increase Notice dated May 7, 2024, the Notice of Payment Percentage Reconsideration dated December 10, 2025, the Category A Maximum Available Payment notice dated August 18, 2026, the Statute of Limitations Notice (2019), the Approved Jobsite List revised November 19, 2018 and its notices dated June 6 and September 12, 2018, the Presumptive Occupations list, the Update Regarding Authentication of Exposure Evidence and Releases effective January 1, 2022, and the deficiency and offer deadlines letter dated January 13, 2016. |
SCHEDULE OF DISEASES
The Yarway TDP uses seven disease levels; mesothelioma is Level VII. Lung Cancer 2 (Level V) has no scheduled value and goes through Individual Review only. The values are the TDP figures; there is no inflation adjustment.
| Level | Disease | Scheduled Value | Payout at 27.5% | IR Average | IR Maximum |
|---|---|---|---|---|---|
| VII | Mesothelioma | $55,000 | About $15,125 | $80,000 | $150,000 |
| VI | Lung Cancer 1 | $17,500 | About $4,813 | $20,000 | $40,000 |
| V | Lung Cancer 2 | None (Individual Review only) | Individually valued | $5,000 | $15,000 |
| IV | Other Cancer | $5,000 | About $1,375 | $6,000 | $15,000 |
| III | Severe Asbestosis | $10,000 | About $2,750 | $12,000 | $20,000 |
| II | Asbestosis / Pleural Disease | $2,000 | About $550 | None | None |
| I | Asbestosis / Pleural Disease | $500 | About $138 | None | None |
The payout column is the scheduled value times 27.5%, rounded. Yarway's scheduled values are modest but its payment percentage is one of the highest among the valve and steam equipment trusts, so a mesothelioma claim pays more than at several trusts with larger scheduled values. The Individual Review average is 45% above the scheduled value and the maximum is nearly three times it, so Individual Review is worth considering for a steamfitter or Navy engine room worker with years of hands-on Yarway trap and valve work and a strong jurisdiction, and the Extraordinary Claim track is in reach for a Yarway or Gimpel plant worker.
FILING REQUIREMENTS
The trust checks three things on every claim: the disease, the exposure, and the timing. There is no fee to check, but there is a payment queue to think about.
The claimant must show meaningful and credible exposure, before December 31, 1982, to the Yarway Product Lines, which the TDP defines broadly as asbestos-containing products, equipment, components, parts, or materials engineered, designed, manufactured, sold, supplied, installed, maintained, serviced, repaired, removed, replaced, or distributed by Yarway Corporation or Gimpel Corporation (TDP Section 5.7(b)(3)). The trust accepts a sworn statement of the injured person or a co-worker, a sworn statement of a family member when the claimant has died, invoices, employment or construction records, or other credible evidence, and it can ask for more. Two trust lists shorten the proof. If the claimant worked at one of the 477 sites on the Approved Jobsite List, the trust has already confirmed its products were there, and the claim needs documentation that the claimant worked at the site plus the usual occupational criteria. If the claimant's job is on the Presumptive Occupations list (boiler worker, coppersmith, machinist, millwright, powerhouse mechanic, sprinkler fitter, steamfitter, maintenance mechanic, pipefitter, plumber, HVAC worker, or a shipyard or shipboard electrician, engine room worker, fireman, sheet metal worker, or shipfitter, in the shipyard, industrial, or railroad industries), the trust does not require detail about how the worker used the product once the product is identified. Mesothelioma needs Yarway Exposure only. Lung Cancer 1, Other Cancer, Severe Asbestosis, and Level II also need six months of Yarway Exposure before December 31, 1982 and Significant Occupational Exposure, which means at least five cumulative years, two of them before December 31, 1982, in an industry and occupation that handled raw asbestos, fabricated asbestos products, worked with asbestos products, or worked regularly alongside those who did (Section 5.7(b)(2)). Level I needs six months of Yarway Exposure plus five years of occupational asbestos exposure. Take-home (secondary) exposure claims go through Individual Review and must show the occupationally exposed person would have met the exposure rules (Section 5.5).
A mesothelioma claim needs a diagnosis of mesothelioma. Lung Cancer 1 and Other Cancer need the cancer diagnosis plus evidence of an underlying Bilateral Asbestos-Related Nonmalignant Disease (a B-read of 1/0 or higher, or an x-ray, CT, or pathology report by a qualified physician showing bilateral disease) and medical documentation that asbestos exposure contributed to the cancer. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.
Anyone first diagnosed after April 22, 2013 may file within three years after diagnosis, regardless of the state statute of limitations (Section 5.1(a)(2)). The alternative deadline, three years after the June 2016 Initial Claims Filing Date, ran out on June 21, 2019, so for a diagnosis today the deadline is three years from the diagnosis date. Claims diagnosed before April 22, 2013 had to be filed by June 21, 2019 if they were pending against Yarway, tolled, or still within the statute of limitations on the Petition Date (Statute of Limitations Notice). After filing, a deficiency must be cured within 180 days and an offer answered within 180 days, or the claim is deferred for up to three years and then deemed withdrawn, with the statute of limitations tolled for a resubmission if it was still running when the claim was first filed.
Expedited Review pays the scheduled value times 27.5% once the claim meets the criteria, about $15,125 for mesothelioma. Individual Review values the claim on the law of the claimant's jurisdiction and the trust's factors, up to $150,000 for mesothelioma, with the average set at $80,000 (about $22,000 at 27.5%). An Extraordinary Claim, for a worker exposed predominantly in a Yarway or Gimpel plant or whose exposure was at least 75% Yarway product, can reach five times the scheduled value, about $75,625 for mesothelioma at 27.5% (Section 5.4(a)). A claimant who rejects the trust's offer can go to arbitration under the trust's ADR Procedures and, after non-binding arbitration, to the tort system.
Yarway is one of the trusts that enforces its annual payment cap. The TDP limits how much the trust pays each year and splits that amount 90% to malignancy and severe asbestosis claims and 10% to non-malignant claims. In 2026 the trust hit 85% of the Category A amount before the August payment run, moved most August payments to October, and announced that no further Category A payments would be made after October until January 2027 or a reset of the payment percentage. A liquidated claim that waits is not reduced; it keeps its payment percentage and goes to the head of the queue. For a client with mesothelioma, that means the Yarway offer should be accepted and the release returned promptly so the claim is liquidated and in line, not held while other trusts are negotiated.
RATE HISTORY
The TDP left the Initial Payment Percentage to the trustee, to be set with the consent of the Trust Advisory Committee and the Future Claimants' Representative promptly after the trust was established (Section 2.3), and the trust's filing instructions record that it was set at 25%. The rate stayed at 25% from the trust's opening in December 2015 until the trustee, after a review with the TAC and the FCR under Section 4.2, raised it to 27.5% effective May 1, 2024 (notice dated May 7, 2024). Claimants paid at 25% received supplemental payments where the TDP permits.
On December 10, 2025 the trustee gave notice that the payment percentage was again under reconsideration, on the recommendation of the trust's advisors, and would be re-determined no sooner than 30 days later. The notice did not say whether the rate would go up or down. It told claimants holding a release to return it within 30 days of receipt, or by the date any proposed change is announced, to lock in the current rate, and said that if a higher rate is adopted, claimants paid at the lower rate would receive supplemental payments. As of October 18, 2026 the trust has posted no new rate, and its August 18, 2026 notice refers to a possible "resetting of the Yarway payment percentage" as one of two events that would restart Category A payments. The trust posts no annual report on its website, so this page carries no claims-paid totals.
PRODUCTS AND WORK SITES
The trust's procedures define covered exposure by product line, as the asbestos-containing products, equipment, components, parts, and materials of Yarway Corporation, Gimpel Corporation, and Gimpel Machine Works (TDP Section 5.7(b)(3)), and the trust's Extraordinary Claim rule and presumptive occupation list point to steam system work: boiler workers, steamfitters, pipefitters, powerhouse mechanics, and shipboard engine room trades. The trust is unusual in publishing both an Approved Jobsite List and a Presumptive Occupations list, and together they do most of the exposure work on a claim.
The firm sees Yarway exposure among Navy and merchant marine engine room workers, power plant and nuclear plant mechanics, and steamfitters and pipefitters in heavy industry, and the same steam system history usually supports claims against Leslie Controls, Babcock & Wilcox, Combustion Engineering, and Garlock. Our pages on power plant asbestos exposure and shipyard asbestos exposure cover the settings where Yarway equipment was serviced, and our Yarway Corporation company page covers the company's history.
QUESTIONS
As of October 18, 2026, the Yarway Asbestos Personal Injury Trust pays 27.5% of a claim's liquidated value. The trustee raised the rate from 25% to 27.5% effective May 1, 2024, with the consent of the Trust Advisory Committee and the Future Claimants' Representative. On December 10, 2025 the trustee announced that the rate is under reconsideration, and the trust has not yet posted a new rate.
The mesothelioma scheduled value is $55,000, so an Expedited Review claim pays about $15,125 at 27.5%. Individual Review averages $80,000 (about $22,000) with a $150,000 maximum (about $41,250). A Yarway or Gimpel plant worker, or a claimant whose exposure was at least 75% Yarway product, can qualify as an Extraordinary Claim worth up to five times the scheduled value, about $75,625 at 27.5%. Because the trust enforces an annual payment cap, a claim liquidated late in the year may be paid the following January at the same rate.
Usually not for a recent diagnosis. Anyone first diagnosed after April 22, 2013 may file within three years after diagnosis regardless of the state statute of limitations. The trust's alternative deadline of June 21, 2019 has passed, so claims diagnosed before April 22, 2013 and not filed by then are late. There is no filing fee.
WHY THRONEBERRY LAW GROUP
Yarway pays better than most of the steam equipment trusts, and it tells you in advance where its products were and which jobs it will take on the product name alone. The work is matching the client to those lists and getting the claim liquidated before the annual cap closes the payment window. We file Yarway because a sailor's or steamfitter's history usually supports several trusts at once, because the approved site and presumptive occupation lists cut the proof to employment records and a diagnosis for most of our clients, and because we track the trust's payment queue so a mesothelioma client's offer is accepted and in line before the fall. We elect Individual Review only where the facts earn it. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and VA benefits, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
