The DII Industries asbestos trust pays 60% of a claim's value. The rate has been 60% since August 21, 2018, when the trustees raised it from 50%. The trust runs two schedules. A Harbison-Walker claim for mesothelioma carries a $144,897.50 scheduled value, so it pays about $86,939 through Expedited Review. A Halliburton claim (Dresser, Kellogg Brown & Root, and the other non-Harbison-Walker companies) for mesothelioma carries a $60,718.95 scheduled value and pays about $36,431. Individual Review averages run higher: $193,196.67 for a Harbison-Walker mesothelioma claim and $81,100.14 for a Halliburton claim.

Throneberry Law Group files DII Industries claims for steelworkers, refinery and power plant workers, cement and foundry workers, bricklayers, and other trades and their families across the country. This page is part of our asbestos trust funds guide, which covers every trust we file against. The trust's Documented Site List runs to 5,340 entries, 352 of them in Illinois, and work at a listed site is presumptive proof of exposure.

PAYMENT REFERENCE

DII Industries Trust Payment Reference

The table below is the short answer. The sections that follow explain each line.

Current payment percentage60% of the liquidated value. One rate for Harbison-Walker claims and Halliburton claims. Other Asbestos Disease (Level I) claims are paid 100% of their scheduled value and are not reduced by the percentage (TDP Section 4.3).
In effect sinceAugust 21, 2018 (Trust Update dated August 21, 2018, after a reconsideration under TDP Section 4.2 with the consent of the Trust Advisory Committee and the Legal Representative). The trust paid supplemental payments to claimants paid at lower rates (Trust Update dated September 18, 2018; about $156 million in supplemental payments in 2018 per the 2018 annual report).
Prior rates50% from late 2016 to August 2018 (raised from 35.6% in 2016 per the 2016 annual report, with about $103 million in additional payments by year end). 35.6% before that. The trust announced a re-evaluation of the 60% rate on February 22, 2023; no change has been posted, and the trust's claim value pages still state 60%.
Review cycleThe trustees must reconsider the rate at least every three years and no more than once a year unless a materially adverse change is shown (TDP Section 4.2). A claim is paid at the rate in effect when it is paid, not when it is filed (Trust Update dated February 22, 2023). If a lower rate has been proposed but not yet adopted, the claim is paid at the lower rate, with the difference paid later if the proposal fails (Section 4.3).
Mesothelioma scheduled valueHarbison-Walker claims: $144,897.50 scheduled; $193,196.67 Individual Review average; $647,527.29 Individual Review maximum. Halliburton (non-Harbison-Walker) claims: $60,718.95 scheduled; $81,100.14 average; $271,749.16 maximum. These are the current values posted on the trust's ER and IR Claim Value pages; the TDP's printed values ($136,500 and $57,200 scheduled) were raised on August 30, 2017 to account at least partly for inflation (TDP Section 5.3(a)(3), footnote 3).
Mesothelioma payout at the current rateHarbison-Walker Expedited Review: about $86,939 ($144,897.50 x 60%). Halliburton Expedited Review: about $36,431 ($60,718.95 x 60%). Individual Review awards are paid at 60% of the liquidated amount, up to the maximum.
Review optionsExpedited Review pays the scheduled value times 60% once the claim meets the medical and exposure criteria (Section 5.3(a)). Individual Review values the claim on the law of the claimant's jurisdiction and the trust's valuation factors, and can come in above or below the scheduled value, up to the maximum (Section 5.3(b)). Lung Cancer 2 (Level VI), secondary exposure, and foreign claims must go through Individual Review. Until the trust makes an Individual Review offer, the claimant may switch to Expedited Review and keep the queue position.
Extraordinary ClaimsUp to five times the scheduled value (Levels II through V, VII, and VIII), or five times the average value (Level VI), times 60%, for a claimant whose exposure was primarily at a Harbison-Walker or Halliburton manufacturing plant while it made asbestos products, or was at least 75% company exposure with little chance of recovery elsewhere (Section 5.4(a)(1)). For a Harbison-Walker mesothelioma claim that is up to $724,487.50, about $434,693 at 60%. Extraordinary Claims go through Individual Review and move ahead of other claims in the payment queue. The trust posts an Extraordinary Claim Certification form.
Exposure requirementCompany Exposure: meaningful and credible exposure before December 31, 1982 to asbestos or asbestos products supplied, specified, used, installed, or manufactured by a Harbison-Walker or Halliburton entity (Section 5.7(c)). Mesothelioma needs company exposure only. Lung Cancer 1, Other Cancer, Severe Asbestosis, and Level III need six months of company exposure before December 31, 1982 plus Significant Occupational Exposure (five cumulative years in an asbestos trade, at least two of them before December 31, 1982). Level II needs six months of company exposure plus five years of occupational asbestos exposure. Working at a site on the trust's Documented Site List during the listed years is presumptive evidence of company exposure.
Filing deadlineA Harbison-Walker claimant first diagnosed after February 14, 2002 (the Harbison-Walker petition date), or a Halliburton claimant first diagnosed after December 16, 2003 (the DII Industries petition date), may file within three years after diagnosis or after November 9, 2005 (the Claims Acceptance Date), whichever is later, even if the state statute of limitations has run (Section 5.1(a)(2)). Claims diagnosed before those dates must satisfy the state statute of limitations that applied when the claim was filed in court or with the trust, with tolling from the petition date.
Fees and withdrawal rulesNo filing fee is posted (Section 6.4 leaves a fee to the trustees' discretion). A claim is deemed withdrawn if the claimant neither accepts, rejects, nor starts arbitration within one year of the trust's offer or rejection, with one six-month extension on request (Section 6.3). Since December 5, 2025, a claim with an intake deficiency (incomplete form or no documents) is deemed withdrawn six months after the latest deficiency notice (Trust Update dated December 5, 2025). Deferral of up to three years keeps the queue position; a withdrawn claim can be refiled without affecting the statute of limitations.
Sequencing adjustmentInterest at the one-year Treasury rate on claims that wait a year or more in the payment queue, capped at seven years and not paid on Level I claims (Section 7.5).

Trust createdJanuary 20, 2005, under the Chapter 11 Joint Plan of Reorganization for DII Industries, LLC (formerly Dresser Industries), Kellogg Brown & Root, Mid-Valley, and related debtors, confirmed by the United States Bankruptcy Court for the Western District of Pennsylvania on July 21, 2004 and affirmed by the District Court on December 1, 2004 (Case No. 03-35592). The trust assumed the asbestos liabilities of Halliburton and its affiliates arising from Harbison-Walker Refractories, Kellogg Brown & Root, Dresser Industries, and certain other businesses. The current procedures are the Ninth Amended Trust Distribution Procedures dated August 29, 2023.

SCHEDULE OF DISEASES

Scheduled Values by Disease Level

The trust sorts asbestos diseases into eight levels and keeps two value schedules: one for Harbison-Walker claims and one for Halliburton (non-Harbison-Walker) claims. Lung Cancer 2 (Level VI) has no scheduled value and goes through Individual Review only. Level I is paid in full and not reduced by the payment percentage. The values below are the current figures on the trust's ER and IR Claim Value pages, which replaced the TDP's printed values after the August 30, 2017 inflation adjustment.

The payout column is the scheduled value times 60%, rounded. Which schedule applies depends on whose product caused the exposure: Harbison-Walker refractory brick, mortar, and castables fall under the Harbison-Walker schedule, and Dresser pumps and compressors, Worthington and Pacific pumps, Alco locomotives, Baroid and IMCO drilling mud, and the other Halliburton products fall under the Halliburton schedule. A worker exposed to both can hold a claim under each schedule, but never more than the full value of one Harbison-Walker claim. The trust has posted notices that Individual Review awards for mesothelioma, Lung Cancer 1, and Other Cancer were trending below the average values (Trust Updates dated September 17, 2019, August 23, 2019, February 8, 2021, and March 19, 2021), and it later adjusted its Other Cancer and Lung Cancer 1 models (Trust Updates dated February 15, 2024 and May 1, 2024). The choice between Expedited and Individual Review is a case-by-case call.

FILING REQUIREMENTS

What a DII Industries Trust Claim Must Show

The trust checks three things on every claim: the disease, the exposure, and the timing. Since December 2025 it also closes claims that sit with an incomplete form or no documents for six months.

Exposure to Harbison-Walker or Halliburton Products

The claimant must show meaningful and credible exposure, before December 31, 1982, to asbestos or asbestos products supplied, specified, used, installed, or manufactured by a Harbison-Walker or Halliburton entity (TDP Section 5.7(c)). Work at a site on the trust's Documented Site List during the years the list gives is presumptive evidence of company exposure. For a site that is not listed, the trust wants a sworn statement, deposition, interrogatory answer, or work history placing the worker at the site with the dates, plus proof that the product was there: sales records, invoices, construction records, or a statement from someone with personal knowledge of the product. If the worker has died, a co-worker or family member can place the worker at the site, but only a co-worker or someone with personal knowledge can prove the product. Mesothelioma needs company exposure only. Lung Cancer 1, Other Cancer, Severe Asbestosis, and Level III also need six months of company exposure before December 31, 1982 and Significant Occupational Exposure, which means at least five cumulative years, two of them before December 31, 1982, in an industry and occupation that handled raw asbestos, fabricated asbestos products, worked with asbestos products, or worked regularly alongside those who did (Section 5.7(b)(2)). Level II needs six months of company exposure plus five years of occupational asbestos exposure. A claimant who cannot meet the presumptive exposure rules can ask for Individual Review.

Medical Proof

Every diagnosis must come with a ten-year latency between first exposure and diagnosis. A mesothelioma claim needs a diagnosis of mesothelioma. The non-malignant levels need a diagnosis of Bilateral Asbestos-Related Nonmalignant Disease based on a physical exam by the diagnosing physician (or pathology if the worker died before the claim was filed), with an x-ray read by a certified B-reader at 1/0 or higher, or an x-ray, CT scan, or pathology report read by a Qualified Physician showing bilateral fibrosis, plaques, thickening, or calcification. Levels III and IV also need pulmonary function tests that meet American Thoracic Society standards (TLC under 80% or FVC under 80% for Level III; TLC under 65% or FVC under 65% plus ILO 2/1 or pathology for Level IV). The trust keeps a list of Unacceptable Doctors and Facilities whose reports it will not accept. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.

Deadlines

For a Harbison-Walker claim, anyone first diagnosed after February 14, 2002 may file within three years after diagnosis or after November 9, 2005, whichever is later, regardless of the state statute of limitations. For a Halliburton claim, the same rule applies to anyone first diagnosed after December 16, 2003 (Section 5.1(a)(2)). For a diagnosis today, that means three years from the diagnosis date for either track. Claims diagnosed before the petition dates follow the state statute of limitations that applied when the claim was filed, with the running of the statute tolled from the petition date, and are treated as timely if filed within three years after November 9, 2005. The trust's one-year deemed-withdrawal rule for unanswered offers and its new six-month rule for intake-deficient claims mean a filed claim still needs attention; we file complete and answer offers on time.

Expedited Review, Individual Review, or Extraordinary Claim

Expedited Review pays the scheduled value times 60% once the claim meets the criteria, about $86,939 for a Harbison-Walker mesothelioma claim and about $36,431 for a Halliburton claim. Individual Review values the claim on the law of the claimant's jurisdiction and the trust's factors (age, dependents, economic loss, disease severity, and the like), up to $647,527.29 for a Harbison-Walker mesothelioma claim and $271,749.16 for a Halliburton claim, with the average running at $193,196.67 and $81,100.14. A claimant can switch from Individual Review to Expedited Review any time before the trust makes an offer and keep the queue position, so the trust's own notices suggest electing Individual Review first when the facts support it. An Extraordinary Claim, for a worker exposed primarily at a Harbison-Walker or Halliburton plant or whose exposure was at least 75% company exposure, can reach five times the scheduled value and jumps the payment queue (Section 5.4(a)(1)). A claimant who rejects the trust's offer can go to arbitration under the trust's ADR Procedures and, after that, to the tort system (Sections 5.10 and 5.11).

RATE HISTORY

How the DII Industries Payment Percentage Has Changed

The trust's payment percentage has only gone up. The trust was paying 35.6% when, in 2016, its professionals updated the forecast of assets and liabilities and the trustees, with the consent of the Trust Advisory Committee and the Legal Representative, raised the rate to 50%, implemented in late 2016 with additional payments to claimants paid at 35.6% (2016 annual report; about $103 million paid by December 31, 2016).

By Trust Update dated August 21, 2018, after another reconsideration under Section 4.2 of the TDP, the trustees raised the rate to 60%, effective immediately, and announced supplemental payments to claimants paid at lower rates (Trust Update dated September 18, 2018; about $156 million in supplemental payments in 2018 per the 2018 annual report). On February 22, 2023 the trust announced it was re-evaluating the 60% rate and expected to finish later that year; the Ninth Amended TDP followed on August 29, 2023, and the trust's claim value pages still state 60% as of October 18, 2026. The trust does not publish the initial payment percentage set at confirmation, and this page does not guess at it.

PRODUCTS AND WORK SITES

Harbison-Walker and Halliburton Products and Who Was Exposed

The trust's Product and Operations List dated August 6, 2018 names the products on each schedule. Under Harbison-Walker: HW Mineral Fiber Coating, Asbestos Millboard, Chromepak G, Lightweight Castable 10, Micacrete 7, and the Metalkase, Exkase, and Tabexkase lines of fire brick (Chromex B, Magnex H XXP, Nucon, Nucon 50, 60, and 80, HW 26-72, HW 31-73, and Guidon SR). Under Halliburton: Clark, Leroi, Roots, and Worthington compressors; Dresser, Pacific, and Worthington pumps; Moore, Worthington, and Worthington-Moore turbines; Galion cranes and road construction equipment; Alco locomotives; and under Kellogg Brown & Root and Mid-Valley, the Baroid, IMCO, and Magcobar asbestos drilling muds (Visbestos, Super Visbestos, Flosal, Diaseal M, Shurlift, Univis, Oilfaze, Visquick, Best, and Super Best). The list can change without notice. Our Harbison-Walker company page covers the company's history.

The Documented Site List dated October 15, 2026 has 5,340 entries (4,540 Halliburton and 800 Harbison-Walker), each with the years the products are documented at the site. Texas has the most entries (477), then Pennsylvania (423), ships and maritime sites (419), California (354), Illinois (352), and Ohio (334). A claim is usually proved one of two ways.

  • A listed site: work at a site on the Documented Site List during the years the list gives, which the TDP treats as presumptive evidence of company exposure.
  • Direct evidence: a sworn statement, deposition, or work history placing the worker at an unlisted site, plus sales records, invoices, construction records, or a co-worker's statement proving the product was there.

The 352 Illinois entries cover the Metro East plants the firm sees most: Shell Oil in Roxana (both schedules), Standard Oil of Indiana in Wood River, Wood River Oil and Refinery in Hartford, Granite City Steel, General Steel Castings, and the Corps of Engineers in Granite City, American Steel Foundry in East St. Louis, Monsanto, Mobil Oil, and Cerro Copper in Sauget, Owens-Illinois Glass in Alton, and the Illinois Power Wood River station in East Alton. Upstate, the list names Caterpillar in Peoria and East Peoria, Hiram Walker in Peoria, the Central Illinois Light stations at Bartonville and Canton, Johns Manville in Waukegan, the Waukegan Generating Station, Great Lakes Naval Training Station, and dozens of Chicago-area sites, from U.S. Steel South Works, Republic Steel, Wisconsin Steel, and Interlake Steel (Harbison-Walker schedule) to the Commonwealth Edison powerhouses, Western Electric's Hawthorne Works, and the Chicago railroads. Harbison-Walker brick also turns up at the cement and lime plants in LaSalle, Oglesby, Dixon, Quincy, and Joppa. Missouri entries include the Harbison-Walker plant in Fulton, Anheuser-Busch, Monsanto, Procter & Gamble, Alpha Portland Cement, and Missouri Portland Cement in St. Louis, Armco Steel and the Kansas City Power & Light stations in Kansas City, and the Union Electric Labadie and Sioux plants. Kansas has 115 entries, including General Motors in Kansas City, Boeing in Wichita, and the Ash Grove cement plants in Chanute. Those are the steel mills, refineries, power plants, and chemical plants where factory workers, bricklayers, refinery workers, power plant workers, and railroad workers breathed the dust. The same furnace and kiln work usually supports claims against the other refractory trusts, A.P. Green, NARCO, and Kaiser Aluminum, and the proof built for one carries the others.

QUESTIONS

Frequently Asked Questions About the DII Industries Trust

What is the current Harbison-Walker / DII Industries trust payment percentage?

As of October 18, 2026, the DII Industries, LLC Asbestos PI Trust pays 60% of a claim's liquidated value. The trustees raised the rate from 50% to 60% by Trust Update dated August 21, 2018, after raising it from 35.6% to 50% in late 2016. The trust announced a re-evaluation in February 2023 but has posted no change.

How much does the DII Industries trust pay for mesothelioma?

It depends on the schedule. A Harbison-Walker mesothelioma claim carries a $144,897.50 scheduled value and pays about $86,939 through Expedited Review; its Individual Review average is $193,196.67 and its maximum is $647,527.29. A Halliburton (non-Harbison-Walker) mesothelioma claim carries a $60,718.95 scheduled value and pays about $36,431; its Individual Review average is $81,100.14 and its maximum is $271,749.16. All figures are before the 60% payment percentage except the Expedited Review payouts, which already apply it.

Is it too late to file a DII Industries trust claim?

Usually not. A Harbison-Walker claimant first diagnosed after February 14, 2002, or a Halliburton claimant first diagnosed after December 16, 2003, may file within three years after diagnosis regardless of the state statute of limitations. The trust does deem claims withdrawn one year after an unanswered offer, and since December 5, 2025 it closes claims with an incomplete form or no documents after six months, so a claim has to be filed complete and followed up.

WHY THRONEBERRY LAW GROUP

Why File Your Harbison-Walker or Halliburton Claim With Throneberry Law Group

The DII Industries trust is one of the better-paying trusts still open, and most of its value sits in choices: Harbison-Walker schedule or Halliburton schedule, Expedited Review or Individual Review, and whether a plant worker's exposure supports an Extraordinary Claim at five times the scheduled value. A firm that files every claim as a Halliburton Expedited Review claim leaves money on the table. We sort the exposure by product first, run the work history against the 5,340-entry Documented Site List, elect Individual Review when the medical and economic facts support it, and switch to Expedited Review before an offer if they don't. Our overview of mesothelioma compensation explains how trust payments fit with lawsuits and other recoveries, and attorney Michael Throneberry, who has handled asbestos cases for more than two decades, reviews every trust claim before it goes out.
