Plibrico Asbestos Trust Payment Percentage, Scheduled Values, and Filing Rules

A payment reference for the Plibrico 524(g) Asbestos Trust, which pays claims for Plibrico Company and Plibrico Sales and Service refractory products. Every figure below was checked against the trust's own website, notices, and Trust Distribution Procedures on October 16, 2026.

The Plibrico asbestos trust pays 0.94% of scheduled value. The trustee set that rate by notice dated August 27, 2024, effective October 1, 2024, down from 1.21%, after paying claims at a proposed 0.88% for the prior fourteen months. A mesothelioma claim carries a $350,000 scheduled value, so an Expedited Review mesothelioma claim pays about $3,290. The same notice added a $52 filing fee, refunded when a claim is paid, and suspended any claim that would pay less than $100. Every claim needs Plibrico exposure before December 31, 1982.

Throneberry Law Group files Plibrico claims for refractory, steel, and furnace workers and their families across the country. The trust covers the products of Plibrico Company, and this page is part of our asbestos trust funds guide, which covers every trust we file against. Plibrico pays less than one cent on the dollar, so we file it alongside the other refractory trusts rather than on its own.

PAYMENT REFERENCE

Plibrico Trust Payment Reference

The table below is the short answer. The sections that follow explain each line.

Current payment percentage0.94% of scheduled value for Expedited Review and of the liquidated value for Individual Review. One rate for all claims.
In effect sinceOctober 1, 2024 (Notice of Payment Percentage Change dated August 27, 2024, adopted with TAC and Futures Representative consent). Claimants paid at the proposed 0.88% between July 14, 2023 and October 1, 2024 receive a supplemental payment for the difference, held until it reaches $100.
Prior rate1.21%, effective October 20, 2020 (proposed September 28, 2020). A proposed 0.88% was paid as an interim rate from July 14, 2023.
Review cycleAt least once every three years, and sooner if the trustee, the TAC, or the Futures Representative asks (TDP Section 4.2). The last change was effective October 1, 2024.
Suspended small claimsSince October 1, 2024 the trust does not process any claim that would pay less than $100 at the current rate. The statute of limitations on those claims is tolled until the rate rises enough to pay $100, and they then have three years from the trust's notice, or three years from diagnosis, whichever is later (notice dated August 27, 2024).
Mesothelioma scheduled value$350,000 (Disease Level VII, TDP Section 5.2(b)(3)). Individual Review average $425,000, maximum $750,000. The TDP calls for an annual CPI adjustment to all three values, capped at 2.5% a year and applied at payment (Section 8.2); the trust has posted no adjusted figures.
Mesothelioma payout at the current rateAbout $3,290 under Expedited Review ($350,000 x 0.94%). Individual Review pays 0.94% of the value the trust sets, up to $750,000 before the percentage, or about $7,050 after it.
Review optionsExpedited Review for Levels I, II, III, IV, VI, and VII. Individual Review only for Lung Cancer 2 (Level V), Extraordinary Claims, and foreign claims.
Exposure requirementMeaningful and credible exposure before December 31, 1982 to a product Plibrico or a predecessor supplied, made, installed, maintained, or repaired (TDP Section 5.6(b)(3)). Mesothelioma and Lung Cancer 2 need Plibrico exposure only. Levels II, III, IV, and VI need six months of Plibrico exposure plus Significant Occupational Exposure (five years in an asbestos trade). Level I needs Plibrico exposure plus Significant Occupational Exposure. Work at one of the 1,303 sites on the trust's Approved Site List (as of August 13, 2007), near Plibrico products during installation or repair, is presumptive evidence of exposure.
Filing deadlineFor anyone diagnosed after the March 13, 2002 petition date, within three years after diagnosis, or by February 1, 2010 (three years after the Initial Claims Filing Date), whichever is later, regardless of any state statute of limitations; a longer state limitations period applies if the claimant's state gives one (TDP Section 5.1(a)(2); Filing Deadlines letter dated June 1, 2009). Claims diagnosed before the petition date had to be filed by February 1, 2010.
Deemed withdrawn policyA claim is treated as withdrawn if the claimant neither accepts, rejects, nor starts arbitration within six months of the trust's offer or rejection, or does not answer a deficiency notice within 180 days (TDP Section 6.3; Deadlines letter dated April 4, 2012). The trust may extend either period once by six months on request. A withdrawn claim can be refiled without losing its limitations status but goes to the back of the queue. A claimant may instead defer the claim for up to three years and keep their place.
Sequencing adjustmentA mesothelioma claim that waits more than two years for a value, for reasons not related to the claim submission, earns an interest-style addition at 2.5% a year; other levels after five years (TDP Section 7.5; factor set by notice dated August 27, 2024).
Extraordinary ClaimsUp to five times the maximum value for the level, multiplied by the payment percentage (TDP Section 5.3(a)). For claims where at least 75% of the exposure was to a specific Plibrico product. Individual Review only, and paid at the head of the queue.
Fees$52 filing fee on every claim filed on or after October 1, 2024, due within 30 days of filing or the claim is treated as never filed and the statute of limitations is not tolled. Refunded in full when the claim is paid (Notice of Claim Filing Fee dated August 2024; TDP Section 6.4).
Claims processorVerus Claims Services.
Claims accepted sinceThe Initial Claims Filing Date was February 1, 2007, six months after the trust first made claim forms available.
Trust createdMarch 8, 2006, under the Chapter 11 plan of Plibrico Company and Plibrico Sales and Service, Inc. Plibrico filed for Chapter 11 on March 13, 2002. The current TDP is the Third Amended and Restated TDP, amended and restated as of October 1, 2024.
Last checkedOctober 16, 2026, against plibricotrust.com, the Third Amended and Restated TDP (October 1, 2024), the Filing Instructions, the Approved Site List as of August 13, 2007, and the trust's notices dated June 1, 2009 (filing deadlines), April 4, 2012 (response deadlines), November 26, 2012, June 28, 2016, September 28 and October 20, 2020, July 14, 2023, and August 27, 2024 (payment percentage, filing fee, and claims processing changes).

SCHEDULE OF DISEASES

Scheduled Values by Disease Level

The trust sorts asbestos diseases into seven levels. Six carry a fixed scheduled value for Expedited Review. Lung Cancer 2 has no scheduled value and goes through Individual Review only. The average and maximum values come from TDP Section 5.2(b)(3) and apply to Individual Review. All three columns are adjusted for inflation at payment under TDP Section 8.2, capped at 2.5% a year since October 1, 2024, and the trust has not published the adjusted figures.

LevelDiseaseScheduled ValueIR AverageIR MaximumER Payout at 0.94%
VIIMesothelioma$350,000$425,000$750,000About $3,290
VILung Cancer 1$120,000$135,000$200,000About $1,128
VLung Cancer 2None$45,000$135,000Individual Review
IVOther Cancer$65,000$70,000$100,000About $611
IIISevere Asbestosis$120,000$135,000$200,000About $1,128
IIAsbestosis / Pleural Disease$15,000$15,000Not setAbout $141
IOther Asbestos Disease$1,500$1,500Not setAbout $14, suspended

The Expedited Review payout is the scheduled value times 0.94%, rounded. Level I claims would pay about $14, so under the August 27, 2024 notice the trust does not process them, and their limitations period is tolled until the rate rises enough to pay $100. The scheduled values are among the highest of any asbestos trust; the rate is among the lowest, and that is why the payout is small.

FILING REQUIREMENTS

What a Plibrico Claim Must Show

The trust checks three things on every claim: the disease, the exposure, and the timing. Since October 1, 2024 it also checks a fourth: whether the $52 filing fee arrived.

Exposure to Plibrico Products

The claimant must show meaningful and credible exposure before December 31, 1982 to an asbestos product that Plibrico Company, Plibrico Sales and Service, or a predecessor supplied, made, installed, maintained, or repaired (TDP Section 5.6(b)(3)). The trust accepts an affidavit from the worker, from a co-worker who can swear that Plibrico products were at the site, or from a family member of a deceased worker, as well as invoices, construction records, and other records from the time. The trust keeps an Approved Site List of 1,303 work sites, as of August 13, 2007, each with the date Plibrico products are known to have been there; work at a listed site near Plibrico products during installation, maintenance, or repair is presumptive evidence of exposure. The TDP says Plibrico's refractory line was specialized, so the trust expects exposure in a limited set of industries and occupations and may discount a claim with mixed industrial exposure. A site that is not on the list can be arbitrated onto it, and a win binds the trust for every later claim. Mesothelioma and Lung Cancer 2 need Plibrico exposure only. Levels II, III, IV, and VI also need six months of Plibrico exposure and Significant Occupational Exposure, which means five years in a trade that handled, cut, or worked next to asbestos products.

Medical Proof

A mesothelioma claim needs a diagnosis based on a physical exam by the diagnosing physician or on a pathology report from a board-certified pathologist or an accredited hospital. Lower levels require the medical findings the TDP lists for that level, such as an ILO reading of 2/1 or higher and reduced lung function for Severe Asbestosis. The National Cancer Institute explains what mesothelioma is and how it is diagnosed.

Deadlines

For anyone diagnosed after March 13, 2002, the TDP's own deadline is three years after diagnosis, and it applies regardless of any state statute of limitations (TDP Section 5.1(a)(2)); if the claimant's state allows longer, the longer period applies. The filing fee changes how that clock works: a claim is not treated as filed, and the limitations period is not tolled, until the $52 fee is paid, and the trust drops the claim if the fee does not arrive within 30 days. Once a claim is in, an offer or rejection left unanswered for six months, or a deficiency notice left unanswered for 180 days, is treated as a withdrawal. A withdrawn claim can be refiled with its limitations status intact but goes to the back of the line, and a claimant who needs time can instead defer for up to three years and keep their place. We file soon after diagnosis, pay the fee with the claim, and answer every notice well inside the window.

Expedited Review or Individual Review

Expedited Review pays the scheduled value times the payment percentage once the claim meets the level's medical and exposure criteria. For mesothelioma that is about $3,290 at 0.94%. Individual Review looks at the whole case and can set a value up to $750,000 for mesothelioma before the percentage, or about $7,050 after it. Lung Cancer 2 claims, foreign claims, and Extraordinary Claims must use Individual Review. An Extraordinary Claim, where at least 75% of the worker's exposure was to a specific Plibrico product, can be valued at up to five times the level's maximum value (TDP Section 5.3(a)), which for mesothelioma is $3,750,000 before the percentage and about $35,250 after it. At 0.94%, the extra time Individual Review takes is rarely worth a few thousand dollars, so most Plibrico claims go through Expedited Review while we spend the effort on the larger trusts in the same work history.

RATE HISTORY

How the Plibrico Payment Percentage Has Changed

The TDP set the initial payment percentage at 1.1% when the trust opened in 2006. The trust's posted notices pick up the story in 2012: after a reconsideration announced June 20, 2012, and a pause in payments that fall, the trustee cut the rate from 1.2% to 1.0% on November 26, 2012. A notice effective June 28, 2016 raised it from 1.2% to 1.36%; the trust has posted no notice dating the step from 1.0% back to 1.2%. On September 28, 2020 the trustee proposed 1.21% and began paying at that rate, and a notice dated October 20, 2020 adopted it.

On July 14, 2023 the trustee proposed 0.88% and began paying claims at that rate under TDP Section 4.3 while the TAC and Futures Representative considered it. The result, by notice dated August 27, 2024, was a rate of 0.94% effective October 1, 2024, a little above the proposal, with supplemental payments to everyone paid at 0.88%. The same notice suspended claims that would pay under $100, set a $52 filing fee, fixed the sequencing adjustment factor at 2.5%, and capped the annual inflation adjustment to claim values at 2.5%, all written into the Third Amended and Restated TDP as of October 1, 2024. The trustee must reconsider the rate again by 2027.

PRODUCTS AND WORK SITES

Plibrico Products and Who Was Exposed

Plibrico Company made and installed refractory products for high-heat equipment, the plastic refractories, castables, and mortars that lined boilers, furnaces, kilns, and ladles. The trust publishes no product list. Its TDP defines covered exposure by company instead, as any asbestos product that Plibrico or a predecessor supplied, made, installed, maintained, or repaired before December 31, 1982, and it describes the product line as specialized and used in a limited set of industries. The trust's Approved Site List is the working tool, and a claim is usually proved one of three ways.

  • A listed job site: work at one of the 1,303 sites on the trust's Approved Site List (as of August 13, 2007), near Plibrico products during their installation, maintenance, or repair, on or after the date the list gives for that site.
  • Direct evidence: an affidavit from the worker, a co-worker, or a family member, or invoices, construction, or similar records showing Plibrico products at an unlisted site.
  • Arbitration onto the list: a claimant who proves Plibrico products were at an unlisted site, or were there outside the listed dates, can add the site or expand the dates through the trust's arbitration procedure, and the decision then applies to every pending and later claim.

Those products went into steel mills, foundries, power plants, refineries, and glass and cement plants. Bricklayers and refractory masons, boilermakers, furnace crews, steelworkers, and the plant workers around them breathed the dust. The same work history usually supports claims against the other refractory trusts, such as NARCO, A.P. Green, Kaiser Aluminum, and Quigley, and the proof built for those trusts carries the Plibrico claim.

QUESTIONS

Frequently Asked Questions About the Plibrico Trust

What is the current Plibrico trust payment percentage?

As of October 16, 2026, the Plibrico 524(g) Asbestos Trust pays 0.94% of scheduled value. The trustee set that rate by notice dated August 27, 2024, effective October 1, 2024, down from 1.21%, after paying a proposed 0.88% from July 14, 2023.

How much does the Plibrico trust pay for mesothelioma?

The mesothelioma scheduled value is $350,000. At the current 0.94% rate, an Expedited Review claim pays about $3,290. Individual Review can set a value up to $750,000 before the percentage, which is about $7,050 at 0.94%.

Is it too late to file a Plibrico trust claim?

Usually not. For anyone diagnosed after March 13, 2002, the trust's own deadline is three years after diagnosis, and the TDP applies it regardless of state statutes of limitations. The exposure must have happened before December 31, 1982, and since October 1, 2024 a claim is not treated as filed until its $52 fee is paid, so the safest step is to file soon after diagnosis with the fee attached.
